ORDINANCE NO. 2005 - 38 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS AMENDING THE TRAFFIC REGISTER MAINTAINED UNDER SECTION 82.067 OF THE SAN MARCOS CITY CODE TO CHANGE THE SOUTH SIDE OF THE 600 BLOCK OF BROADWAY STREET FROM "NO PARKING ANYTIME" TO "NO PARKING - TOW AWAY MON. - FRI. 7:30 A.M. - 4:30 P.M."; INCLUDING PROCEDURAL PROVISIONS; AND PROVIDING FOR PENALTIES. RECITALS: 1. The Traffic Register, required by Section 82.067 of the City Code of Ordinances, needs to be amended to allow illegally parked cars to be towed from the south side of the 600 block of Broadway Street in order to curtail student parking and alleviate the traffic congestion problems during school hours. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: SECTION 1. Pursuantto Section 82.161 ofthe City of San Marcos Code of Ordinances, the Traffic Register is amended to amend the no parking zone for illegally parked cars on the south side of the 600 block of Broadway Street and change the attendant signage to "No Parking - Tow Away Mon. - Fri. 7:30 a.m. - 4:30 p.m.". SECTION 2. If any word, phrase, clause, sentence, or paragraph of this ordinance is held to be unconstitutional or invalid by a court of competent jurisdiction, the other provisions ofthis ordinance will continue in force if they can be given effect without the invalid portion. SECTION 3. All ordinances and resolutions or parts of ordinances or resolutions in conflict with this ordinance are repealed. SECTION 4. This ordinance shall be in effect ten (10) days from and after its passage, and the City Clerk will publish notice of its adoption in a newspaper of general circulation in the City.
