<br />168. <br /> <br />RESOLUTION NO. 2005 --6+-R <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS APPROVING A LETTER AGREEMENT WITH THE <br />BAUGH FAMILY PARTNERSHIP, LTD. FOR TIffi CITY'S <br />ACQUISITION OF PERMANENT AND TEMPORARY EASEMENTS <br />FOR THE EL CAMINO REAL WATER TRANSMISSION MAIN <br />PROJECT; AND DECLARING AN EFFECTIVE DATE. <br /> <br />RECITALS: <br /> <br />1. The EI Camino Real Water Transmission Main project (the "Project") is being constructed in <br />phases, and will provide a major transmission water pipeline originating at the San Marcos Water Treatment <br />Plant and terminating near the proposed high school located at the comer of McCarty Lane and Old Bastrop <br />Highway. <br /> <br />2. The Project will serve several purposes including supporting development and ensuring water <br />availability and pressure throughout the southeastern segments of the San Marcos water service area. <br /> <br />3. Phase II of the Project requires the City to acquire a 5.266 acre permanent easement and a temporary <br />working easement (together, the "Easements") across property owned by the Baugh Family Partnership, Ltd., <br />traversing over one mile generally along and parallel to the Baugh family property line and Old Bastrop <br />Highway (County Road 266). <br /> <br />4. The staff recommends approval of the attached letter agreement for the acquisition of the <br />Easements. <br /> <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: <br /> <br />PART 1. The attached Letter Agreement with the Baugh Family Partnership, Ltd. for the City's <br />acquisition of the Easements is approved. <br /> <br />PART 2. The City Manager, Dan O'Leary, is authorized to execute the attached Letter <br />Agreement and other documents related to the City's acquisition of the Easements. <br /> <br />PART 3.
