<br />14. <br /> <br />RESOLUTION NO. 2002- 44 R <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, APPROVING THE TERMS AND CONDITIONS <br />OF AN EARNEST MONEY CONTRACT BETWEEN THE CITY <br />AND ALAN CUMMINGS, INC. FOR THE CITY'S ACQUISITION OF <br />A 97 ACRE, MORE OR LESS, TRACT OF LAND ADJACENT TO <br />THE WASTEWATER TREATMENT PLANT SITE; AUTHORIZING <br />THE CITY MANAGER TO EXECUTE THE AGREEMENT ON <br />BEHALF OF THE CITY, AND DECLARING AN EFFECTIVE DATE. <br /> <br />RECITALS: <br /> <br />1. The City has undertaken a study to detennine the feasibility of constructing reservoirs for the <br />storage of raw water and reclaimed water. <br /> <br />2. A potential site for constructing a reservoir for the storage of reclaimed water is the 97 acre, <br />more or less, tract ofland owned by Alan Cummings, Inc., located adjacent to the City's wastewater <br />treatment plant on River Road. <br /> <br />3. The Cummings tract is being actively marketed, and the City wishes to execute an earnest <br />money contract with Alan Cummings, Inc. for the purchase of the Cummings Tract, contingent on the <br />results of the reservoir feasibility study. <br /> <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: <br /> <br />PART 1. The attached Unimproved Property Commercial Contract between the City of San <br />Marcos and Alan Cummings, Inc. for the City's acquisition of a 97 acre, more or less, tract of land <br />located adjacent to the City's wastewater treatment plant on River Road is approved. <br /> <br />PART 2. The City Manager, Larry D. Gilley, is authorized to execute the attached <br />agreements on behalf of the City. <br /> <br />PART 3.
