<br />18. <br /> <br />RESOLUTION 2002 - 46 R <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, APPROVING THE TERMS AND CONDITIONS OF A <br />LEASE AGREEMENT WITH FENWAY PARTNER, L.P. FOR OFFICE <br />SPACE TO PROVIDE WIC PROGRAM SERVICES IN SEGUIN, TEXAS; <br />AUTHORIZING THE CITY MANAGER TO EXECUTE THE LEASE <br />AGREEMENT ON BEHALF OF THE CITY AND DECLARING AN <br />EFFECTIVE DATE. <br /> <br />RECITALS: <br /> <br />1. The City of San Marcos WIC program leases space in Seguin, Texas to provide <br />services to pregnant and postpartum women, breast feeding mothers, infants, and children up to five <br />years of age. The program, including the lease, is funded 100% by the Texas Department of Health. <br /> <br />2. In September, 1997, the City began leasing office space from Great Oak, L.L.C. for <br />the WIC offices in Seguin. The rent was $1346.79 per month. The lease was for five years, with <br />a 60 month renewal option, resulting in an expiration date of September 2002. <br /> <br />3. In September, 1998, Great Oak agreed to construct interior improvements for WIC <br />if the costs did not exceed $12,000. Unfortunately, the lowest bid was for $23,866 and the build <br />out was not performed. <br /> <br />4. Recently, the building in which WIC is located changed hands. The new owners, <br />Fenway, L.P., have agreed to perform the build out. In exchange, the City is agreeing to renew the <br />lease 6 months early and is agreeing to pay an extra $54.79 in rent. This increase is also funded by <br />the Texas Department of Health. <br /> <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: <br /> <br />p ART 1. The terms and conditions of the attached Lease Amendment between the <br />City and Fenway Partner, L.P. for office space located in the Seguin Five Courts Mall to <br />accommodate the WI C Program in Seguin, Texas, are approved <br /> <br />PART 2. The City Manager, Larry D. Gilley, is authorized to execute the attached <br />Lease Agreement on behalf of the City. <br /> <br />PART 3. <br />its passage. <br /> <br />This Resolution shall be in full force and effect immediately from and after <br />
