<br />21. <br /> <br />RESOLUTION NO. 2002- 100 R <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF <br />SAN MARCOS, TEXAS, APPROVING AN EASEMENT <br />AGREEMENT WITH THE SAN MARCOS CONSOLIDATED <br />INDEPENDENT SCHOOL DISTRICT RELATED TO DE <br />ZA V ALA DRIVE; AND DECLARING AN EFFECTIVE DATE. <br /> <br />RECITALS <br /> <br />1. The San Marcos Consolidated Independent School District (the "School District") <br />constructed De Zavala Drive in 1987-88 to provide access to De Zavala Elementary School and <br />the San Marcos High School. <br /> <br />2. The School District is willing to convey, and the City is willing to accept, an easement <br />covering De Zavala Drive and an additional parallel easement area in accordance with the terms <br />of the attached Easement Agreement. <br /> <br />3. Acceptance of this easement will provide for City maintenance of, and control over, the <br />easement area for right-of-way, street and public utility purposes. <br /> <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br />P ART 1. The terms and conditions of the Easement Agreement attached to this resolution <br />are approved. <br /> <br />PART 2. The City Attorney, Mark B. Taylor, is authorized to accept and record the <br />Easement Agreement on behalf of the City. <br /> <br />P ART 3.
