<br />204 <br /> <br />RESOLUTION NO. 2002- 156 R <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS DESIGNATING THE PLANNING AND ZONING <br />COMMISSION AS THE CITY'S CAPITAL IMPROVEMENTS <br />ADVISORY COMMITTEE FOR IMPACT FEES; AND DECLARING <br />AN EFFECTIVE DATE. <br /> <br />RECITALS: <br /> <br />1. TEX Loc. GOy'T CODE S395.058(a) requires the City Council to appoint a capital <br />improvements advisory committee for impact fees under TEX Loc. GOy'T CODE Ch. 395. <br /> <br />2. TEX Loc. GOy'T CODE S395.058(b) provides that the City's Planning and Zoning <br />Commission can act as the capital improvements advisory committee, and that if the Commission does <br />not have a member who is a representative of the real estate, development or building industry, the <br />Commission may act as the advisory committee if the City Council appoints such a representative as an <br />ad hoc voting member of the Commission when it acts as the advisory committee. <br /> <br />3. The City Council wishes to designate the Planning and Zoning Commission as the City's <br />capital improvements advisory committee for impact fees established under TEX Loc. GOy'T CODE Ch. <br />395. <br /> <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: <br /> <br />PART 1. The City Planning and Zoning Commission is designated as the City's capital <br />improvements advisory committee for impact fees under TEX Loc. GOy'T CODE Ch. 395. <br /> <br />PART 2. When the Commission acts as the capital improvements advisory committee, it will <br />include an ad hoc voting member appointed by the City Council to represent the real estate, <br />development or building industry. <br /> <br />P ART 3.
