Ch ~t. ~ g.m ;/0 ~ AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS AMENDING THE TRAFFIC REGISTER MAINTAINED UNDER SECTION 82.067 OF THE SAN MARCOS CITY CODE BY THE ADDITION OF A CONSTRUCTION SPEED LIMIT ON STATE HIGHWAY 80 AND STATE HIGHWAY 21; INCLUDING PROCEDURAL PROVISIONS; AND PROVIDING FOR PENALTIES. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: SECTION 1. Pursuant to Sections 82.003 and 82.066 of the San Marcos Code of Ordinances, on the basis of an engineering and traffic investigation, and on the request of TXDOT, the traffic register maintained under Section 82.067 of the San Marcos Code of Ordinances is amended by adding the following speed limit: State Highway 80 from the east side of the Blanco River Bridge (milepoint 0.872) to a point 1.031 miles east from the point of beginning - construction speed limit of 40 m.p.h. State Highway 80 from a point 1.031 miles east 0 the Blanco River Bridge (milepoint 1.835) to a point .242 miles east from the point of beginning (milepoint 2.077) - construction speed limit of 50 m.p.h. State Highway 21 from the intersection of State Highway 80 and State Highway 21 (milepoint 0.00) to a point .409 miles north (milepoint 0.409) - construction speed limit of 40 m.p.h. SECTION 2. If any word, phrase, clause, sentence, or paragraph of this ordinance is held to be unconstitutional or invalid by a court of competent jurisdiction, the other provisions of this ordinance will continue in force if they can be given effect without the invalid portion. SECTION 3. All ordinances and resolutions or parts of ordinances or resolutions in conflict with this ordinance are repealed. SECTION 4. Any person violating any provision of this ordinance commits a misdemeanor and is subject to the penalty provided in Section 1.015 of the San Marcos City Code. SECTION 5. This ordinance shall be in effect ten (10) days from and after its passage, and the City Secretary will publish notice of its adoption in a newspaper of general circulation in the City.
