On September 25, 2002, the City Council adopted an ordinance (the "Impact Fee Update Ordinance") approving revised land use assumptions, a revised impact fee capital improvements plan, and revised impact fee amounts for water and wastewater facilities. 2. Section 16 of the Impact Fee Update Ordinance provides in pm1 that Schedule 2 of the Impact Fee Update Ordinance, setting the amounts of water and wastewater impact fees, may be amended without revising the approved land use assumptions and capital improvements plan at any time prior to the periodic update of these matters required under state law, as long as the amended impact fee amounts do not exceed the maximum impact fee amounts per service unit set in Schedule 1 of the Impact Fee Update Ordinance. 3. The City Council desires to revise the actual water and wastewater impact fee amounts set in Schedule 2 of the Impact Fee Update Ordinance. 4. The Impact Fee Update Ordinance provides for an exception from the application of the revised impact fee amounts and service unit calculation methodology for developments that had achieved master plan approval prior to the effective date of the ordinance, and the City Council wishes to limit the duration of this exception. 5. The City Council held public hearings on October 14,2002 and October 28, 2002 on possible revisions to the amounts of impact fees for water and wastewater facilities. 6. The City Council finds and determines that the City has fully complied with Chapter 395 of the Texas Local Government Code, as amended, with respect to the processes needed to revise the amounts of the City's impact fees for water and wastewater facilities. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: SECTION 1. The amounts of the water facilities impact fee and wastewater facilities impact fee, set in Schedule 2 of the Impact Fee Update Ordinmlce are amended to read as shown on the attached Schedule 2 for the respective time periods stated therein.
