<br />52. <br /> <br />RESOLUTION 2001- 104 R <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS APPROVING AN EMERGENCY LEASE/PURCHASE CONTRACT <br />WITH PALL CORPORATION FOR WATER FILTRATION EQUIPMENT FOR <br />THE OAK RIDGE WELLS; AUTHORIZING THE CITY MANAGER TO <br />EXECUTE THE CONTRACT DOCUMENTS ON BEHALF OF THE CITY; <br />AND DECLARING AN EFFECTIVE DATE. <br /> <br />RECITALS: <br /> <br />1. There is an emergency situation related to the influence of groundwater on <br />the Oak Ridge wells. <br /> <br />2. TNRCC has notified the City that it is in violation of regulatory requirements <br />and mandated public notification regarding the wells. <br /> <br />3. Pall Corporation offers the only filtration technology that can meet the <br />operating conditions of the Oakridge site. <br /> <br />4. It is necessary to enter into this lease/purchase contract with Pall Corporation <br />as a sole source procurement on an emergency basis without formal competitive bidding <br />in order to preserve and protect the public health and safety of the City's residents. <br /> <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br />PART 1. The emergency lease/purchase contract with Pall Corporation for <br />water filtration equipment for the Oak Ridge Wells in the amount of in the amount of <br />$68,000.00 is approved. <br /> <br />PART 2. The City Manager, Larry D. Gilley, is authorized to execute the contract <br />documents on behalf of the City. <br /> <br />PART 3. This Resolution shall be in full force and effect immediately from and <br />after its passage. <br /> <br />ADOPTED this the 11 th day of June, <br /> <br />2001. <br /> <br /> <br />"'- <br /> <br />David Chiu <br />Mayor <br />
