46. ORDINANCE 2001- 71 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AMENDING THE OFFICIAL ZONING MAP OF THE CITY BY REZONING A 7.43 ACRE TRACT OF PROPERTY LOCATED IN THE 100 BLOCK OF SUNCREST LANE FROM "R-1 " SINGLE-FAMILY DWELLING DISTRICT (LOW DENSITY) TO "LB" LIMITED BUSINESS DISTRICT; INCLUDING PROCEDURAL PROVISIONS; AND PROVIDING FOR PENALTIES. RECITALS: 1. On August 14, 2001, the Planning and Zoning Commission of the City of San Marcos held a public hearing regarding a request to change the zoning from "R-1" Single-Family Dwelling District (Low Density) to "LB" Limited Business District for a 7.43 acre tract of property located in the 1 00 Block of Suncrest Lane. 2. Subsequent to the public hearing on that date, the Planning and Zoning Commission did, on August 14, 2001 consider and vote to approve the request, and has recommended that the request be approved by the City Council of the City. 3. The City Council held a public hearing on the 8th day of October 200 I, regarding the request. 4. All requirements of Chapter 114, Zoning, of the San Marcos City Code pertaining to zoning map amendments have been met. 5. The City Council hereby finds and determines that the adoption of the following ordinance is in the interest of the public health, morals, welfare and safety. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: SECTION 1. The Official Zoning Map of the City, as described in Section 114.029 of the San Marcos City Code, is amended to rezone the following real property which is presently zoned "R-l" Single-Family Dwelling District (Low Density) to "LB" Limited Business District: Street address: 1 00 Block of Suncrest Lane Size: 7.43 acres.
