<br />231. <br /> <br />RESOLUTION NO. 2001- 216 R <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, APPROVING THE TERMS AND CONDITIONS OF A REVISED <br />CONSERVATION EASEMENT AGREEMENT BETWEEN THE CITY AND THE <br />EDWARDS AQUIFER AUTHORITY RELATED TO THE SAN MARCOS <br />REGIONAL P ARK PRESERVE PROJECT; AUTHORIZING THE CITY <br />MANAGER TO EXECUTE THE AGREEMENT ON BEHALF OF THE CITY <br />AND DECLARING AN EFFECTIVE DATE. <br /> <br />RECITALS: <br /> <br />1. The City staff has negotiated an agreement with the Edwards Aquifer Authority (the <br />"EAA") under which the EAA will provide the City with $500,000 towards the cost of the City's <br />purchase of a 326 acre tract of property from C&G Development, Inc. in exchange for a conservation <br />easement (the "Easement"). <br /> <br />2. The area of the Easement (the "Easement Area") comprises the bulk of the 326 acre tract, <br />and is in a substantially undisturbed natural condition. The City and the EAA desire to protect the <br />integrity of the Easement Area from misuse, waste, or residential, industrial, or commercial <br />development. The purposes of this Easement are to preserve the natural condition of the Easement <br />Area, to protect the Easement Area's natural resources, watershed, recharge water quality, and <br />ecological integrity, to protect and preserve native vegetation, habitat and native wildlife including <br />threatened and endangered species, to provide for the research, educational and monitoring activities <br />of the EAA, and to add the Easement Area to the San Marcos Regional Park Preserve. <br /> <br />3. The EAA Board approved a version of the agreement on December 11, 2001 that is <br />slightly different from the version approved by the City Council on December 10, 2001, and the City <br />Council wishes to approved the revised version of the agreement as approved by the EAA Board. <br /> <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br />PART 1. The attached revised Conservation Easement Agreement between the City of San <br />Marcos and the EAA is approved. <br /> <br />PART 2. The City Manager, Larry D. Gilley, is authorized to execute the revised agreement <br />on behalf of the City. <br /> <br />P ART 3.
