ORDINANCE NO. 2011- 4 8 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AMENDING THE CITY'S 2010- 2011 BUDGET TO AUTHORIZE THE EXPENDITURE OF $195,080 FROM FUND BALANCE IN THE GENERAL FUND TO PROVIDE AN ADDITIONAL $100,000 FOR PAYMENT OF UNEMPLOYMENT COMPENSATION AND TERMINATION LEAVE AND AN ADDITIONAL $95,080 FOR THE PURCHASE OF FUEL AND LUBRICANTS; ELIMINATING THE INTERNAL SERVICE FUND FOR CAPITAL REPLACEMENT AND TRANFERRING THE BALANCE OF THAT FUND TO THE GENERAL FUND; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: SECTION 1. The City Budget Ordinance for the 2010 -2011 Fiscal Year is amended as set forth in the attached Exhibit A. This amendment appropriates $195,080 from fund balance in the General Fund to provide an additional $100,000 for payment of unemployment compensation and termination leave and an additional $95,080 for the purchase of fuel and lubricants. This amendment eliminates the Internal Service Fund for Capital Improvements and transfers the remaining balance of $1,311,299.88 from that fund to the General Fund. SECTION 2. These revisions will be incorporated into the 2010 -2011 City Budget. SECTION 3. If any word, phrase, clause, sentence, or paragraph of this ordinance is held to be unconstitutional or invalid by a court of competent jurisdiction, the other provisions of this ordinance will continue in force if they can be given effect without the invalid portion. SECTION 4. All ordinances and resolutions or parts of ordinances or resolutions in conflict with this ordinance are repealed. SECTION 5. This ordinance will take effect immediately after its passage, approval and adoption on second reading. PASSED AND APPROVED on first reading on September 6, 2011.
