'1Cl. <br />~.: 01 0 L:U~ <br /> <br />J;i~ ~ ~~ <br /> <br />56 <br /> <br />ORDINANCE 2000--.45... <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY <br />OF SAN MARCOS, TEXAS, AMENDING THE OFFICIAL <br />ZONING MAP OF THE CITY BY REZONING A 2.56 <br />ACRE TRACT OF PROPERTY LOCATED AT 2216 IH-35 <br />SOUTH FROM "I" INDUSTRIAL DISTRICT TO "C-2" HEAVY <br />COMMERCIAL DISTRICT; INCLUDING PROCEDURAL <br />PROVISIONS; AND PROVIDING FOR PENALTIES. <br /> <br />RECITALS: <br /> <br />1. On April 11, 2000, the Planning and Zoning Commission of the City of San <br />Marcos held a public hearing regarding a request to change the zoning from "I" <br />Industrial District to "C-2" Heavy Commercial District for a 2.56 acre tract of property <br />located at 2216 IH-35 South. <br /> <br />2. Subsequent to the public hearing on that date, the Planning and Zoning <br />Commission did, on April 11, 2000 consider and vote to approve the request, and has <br />recommended that the request be approved by the City Council of the City. <br /> <br />3. The City Council held a public hearing on the 22nd <br />May , 2000, regarding the request. <br /> <br />day of <br /> <br />4. All requirements of Chapter 114, Zoning, of the San Marcos City Code <br />pertaining to zoning map amendments have been met. <br /> <br />5. The City Council hereby finds and determines that the adoption of the <br />following ordinance is in the interest of the public health, morals, welfare and safety. <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br />SECTION 1. The Official Zoning Map of the City, as described in Section <br />114.029 of the San Marcos City Code, is amended to rezone the following real property <br />which is presently zoned "I" Industrial District to "C-2" Heavy Commercial District: <br /> <br />Street address: <br /> <br />2216 IH-35 South. <br /> <br />Size: 2.56 acres. <br /> <br />Leqal description: See the metes and bounds description attached as Exhibit A. <br /> <br />Deed or plat reference: Volume 1253, page 120, Hays County Official Public <br />Records. <br /> <br />SECTION 2. The Future Land Use Plan of the San Marcos Horizons City Master <br />Plan is revised to conform to this zoning map amendment. <br /> <br />SECTION 3. Any person violating any provision of this ordinance commits a <br />misdemeanor and is subject to the penalty provided in Section 1.015 of the San Marcos <br />City Code upon conviction. <br /> <br />SECTION 4. After its original passage, this ordinance will be subject to <br />reconsideration at the next regular City Council meeting. If this ordinance is not <br />reconsidered, or if it is reconsidered and approved, notice of its adoption will be <br />published in a newspaper of general circulation in the City. This ordinance will take <br />effect upon publication of this notice. <br />
