<br />190. <br /> <br /> <br />t<:) <br />(3 <br />~ <br />"- <br /> <br />6 <br /> <br /> <br />ORDINANCE 2000-2L- <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY <br />OF SAN MARCOS, TEXAS, AMENDING THE OFFICIAL <br />ZONING MAP OF THE CITY BY REZONING LOT 10, AM. <br />RAMSAY ADDITION LOCATED AT 318 MILL STREET <br />FROM "M" SINGLE-FAMILY, DUPLEX AND <br />NEIGHBORHOOD BUSINESS DISTRICT TO "DP-2" TWO- <br />FAMILY DWELLING DISTRICT; INCLUDING <br />PROCEDURAL PROVISIONS; AND PROVIDING FOR <br />PENAL TIES. <br /> <br />RECITALS: <br /> <br />1. On July 11, 2000, the Planning and Zoning Commission of the City of San <br />Marcos held a public hearing regarding a request to change the zoning from "M" Single- <br />Family, Duplex and Neighborhood Business District to "DP-2" Two-Family Dwelling <br />District (Medium Density) for Lot 10, AM. Ramsay Addition located at 318 Mill Street. <br /> <br />2. Subsequent to the public hearing on that date, the Planning and Zoning <br />Commission did, on July 11, 2000 consider and vote to approve the request, and has <br />recommended that the request be approved by the City Council of the City. <br /> <br />3. The City Council held a public hearing on the 28th day of <br />AUCJust , 2000, regarding the request. <br /> <br />4. All requirements of Chapter 114, Zoning, of the San Marcos City Code <br />pertaining to zoning map amendments have been met. <br /> <br />5. The City Council hereby finds and determines that the adoption of the <br />following ordinance is in the interest of the public health, morals, welfare and safety. <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br />SECTION 1. The Official Zoning Map of the City, as described in Section <br />114.029 of the San Marcos City Code, is amended to rezone the following real property <br />which is presently zoned "M" Single-Family, Duplex and Neighborhood Business District <br />to "DP-2" Two-Family Dwelling District (Medium Density): <br /> <br />Street address: <br /> <br />318 Mill Street <br /> <br />Leqal description: Lot 10, AM. Ramsay Addition. <br /> <br />Deed or plat reference: Volume 89, pages 477-479, Hays County Deed <br />Records. <br /> <br />SECTION 3. Any person violating any provision of this ordinance commits a <br />misdemeanor and is subject to the penalty provided in Section 1.015 of the San Marcos <br />City Code upon conviction. <br /> <br />SECTION 4. After its original passage, this ordinance will be subject to <br />reconsideration at the next regular City Council meeting. If this ordinance is not <br />reconsidered, or if it is reconsidered and approved, notice of its adoption will be <br />published in a newspaper of general circulation in the City. This ordinance will take <br />effect upon publication of this notice. <br /> <br />PASSED, APPROVED AND ADOPTED this 28Uday of August ,2000, <br />subject to reconsideration at the next regular City Council meeting scheduled for <br />September 11, 2000. <br />
