190. t<:) (3 ~ "- 6 ORDINANCE 2000-2L- AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AMENDING THE OFFICIAL ZONING MAP OF THE CITY BY REZONING LOT 10, AM. RAMSAY ADDITION LOCATED AT 318 MILL STREET FROM "M" SINGLE-FAMILY, DUPLEX AND NEIGHBORHOOD BUSINESS DISTRICT TO "DP-2" TWO- FAMILY DWELLING DISTRICT; INCLUDING PROCEDURAL PROVISIONS; AND PROVIDING FOR PENAL TIES. RECITALS: 1. On July 11, 2000, the Planning and Zoning Commission of the City of San Marcos held a public hearing regarding a request to change the zoning from "M" Single- Family, Duplex and Neighborhood Business District to "DP-2" Two-Family Dwelling District (Medium Density) for Lot 10, AM. Ramsay Addition located at 318 Mill Street. 2. Subsequent to the public hearing on that date, the Planning and Zoning Commission did, on July 11, 2000 consider and vote to approve the request, and has recommended that the request be approved by the City Council of the City. 3. The City Council held a public hearing on the 28th day of AUCJust , 2000, regarding the request. 4. All requirements of Chapter 114, Zoning, of the San Marcos City Code pertaining to zoning map amendments have been met. 5. The City Council hereby finds and determines that the adoption of the following ordinance is in the interest of the public health, morals, welfare and safety. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: SECTION 1. The Official Zoning Map of the City, as described in Section 114.029 of the San Marcos City Code, is amended to rezone the following real property which is presently zoned "M" Single-Family, Duplex and Neighborhood Business District to "DP-2" Two-Family Dwelling District (Medium Density): Street address: 318 Mill Street Leqal description: Lot 10, AM. Ramsay Addition. Deed or plat reference: Volume 89, pages 477-479, Hays County Deed Records. SECTION 3. Any person violating any provision of this ordinance commits a misdemeanor and is subject to the penalty provided in Section 1.015 of the San Marcos City Code upon conviction. SECTION 4. After its original passage, this ordinance will be subject to reconsideration at the next regular City Council meeting. If this ordinance is not reconsidered, or if it is reconsidered and approved, notice of its adoption will be published in a newspaper of general circulation in the City. This ordinance will take effect upon publication of this notice. PASSED, APPROVED AND ADOPTED this 28Uday of August ,2000, subject to reconsideration at the next regular City Council meeting scheduled for September 11, 2000.
