MCGEHEE <br />ADDITION LOCATED AT THE INTERSECTION OF BLANCO AND <br />BURLESON STREETS FROM "P" PUBLIC AND INSTITUTIONAL <br />DISTRICT TO "TH-1" TOWNHOUSE RESIDENTIAL DISTRICT (LOW <br />DENSITY); INCLUDING PROCEDURAL PROVISIONS; AND <br />PROVIDING FOR PENALTIES. <br /> <br />RECITALS: <br /> <br />1. On August 22, 2000, the Planning and Zoning Commission of the City of San Marcos held a <br />public hearing regarding a request to change the zoning from "P" Public and Institutional District to "TH-1" <br />Townhouse Residential District (Low Density) for Lots 7 & 8, Block 2, C.L. McGehee Addition located at <br />the intersection of Blanco and Burleson Streets. <br /> <br />2. Subsequent to the public hearing on that date, the Planning and Zoning Commission did, on <br />consider and vote to approve the request, and has recommended that the request be approved by the <br />City Council of the City. <br /> <br />3. The City Council held a public hearing on the 9th day of October <br />regarding the request. <br /> <br />,2000, <br /> <br />4. All requirements of Chapter 114, Zoning, of the San Marcos City Code pertaining to zoning <br />map amendments have been met. <br /> <br />5. The City Council hereby finds and determines that the adoption of the following ordinance is in <br />the interest of the public health, morals, welfare and safety. <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: <br /> <br />SECTION 1. The Official Zoning Map of the City, as described in Section 114.029 of the San <br />Marcos City Code, is amended to rezone the following real property which is presently zoned "P" Public <br />and Institutional District to "TH-1" Townhouse Residential District (Low Density): <br /> <br />Street address: Intersection of Blanco and Burleson Streets. <br /> <br />Leqal description: Lots 7 & 8, Block 2, C.L. McGehee Addition. <br /> <br />Deed or plat reference: Volume H, page 573, Hays County Deed Records. <br /> <br />SECTION 2. Any person violating any provision of this ordinance commits a misdemeanor and <br />is subject to the penalty provided in Section 1.015 of the San Marcos City Code upon conviction. <br /> <br />SECTION 3. After its original passage, this ordinance will be subject to reconsideration at the <br />next regular City Council meeting. If this ordinance is not reconsidered, or if it is reconsidered and <br />approved, notice of its adoption will be published in a newspaper of general circulation in the City.
