<br />I <br /> <br />I <br /> <br />I <br /> <br />147. <br /> <br />RESOLUTION NO. 2004- 197 R <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF <br />SAN MARCOS, TEXAS, APPROVING PRICE $ELECT OPTIONS <br />FOR THE PURCHASE OF WHOLESALE POWER FROM THE <br />LOWER COLORADO RIVER AUTHORITY; AUTHORIZING <br />THE CITY MANAGER TO EXECUTE A PRICE $ELECT 2005 <br />FUEL & POWER COST RECOVERY SELECTION FORM AND A <br />PRICE $ELECT 2005 PRICING SELECTION FORM ON BEHALF <br />OF THE CITY; AND DECLARING AN EFFECTIVE DATE. <br /> <br />RECITALS: <br /> <br />1. The City purchases electric power from the Lower Colorado River Authority ("LCRA") <br />under a Wholesale Power Agreement dated July 8, 1986, as amended by the Amendment to <br />Wholesale Power Agreement dated June 24, 1996. <br /> <br />2. LCRA uses a Price $elect option program to allow its wholesale customers to choose <br />among pricing options for the purchase of wholesale electric power, and the City wishes to select <br />Price $elect wholesale electric power pricing options for calendar year 2005. <br /> <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: <br /> <br />P ART 1. The pricing options for the purchase of electric power from the LCRA as shown on <br />the City's Price $elect 2005 Selection Form are approved. <br /> <br />PART 2. The City Manager, Dan O'Leary, is authorized to execute the City's Price $elect <br />2004 Selection Form on behalf of the City. <br /> <br />PART 3. In accordance with Resolution No. 2001-195R, the City's Price $elect 2005 <br />Selection Form relates to "power supply pricing, proposals and contracts," and therefore constitutes <br />"competitive information" under Section 552.131 ofthe Texas Government Code. The City's Price <br />$elect 2004 Selection Fonn is not public information and is not subject to disclosure to the public. <br /> <br />P ART 4.
