Section 102.026 of the City Code adopts the San Marcos Horizons City Master Plan as the <br />master plan for the physical development ofthe City, and Section 102.029 ofthe City Code provides <br />for the adoption of sector plans as appendices to the San Marcos Horizons City Master Plan. <br /> <br />2. Section 7.02 of the City Charter requires the City Planning and Zoning Commission to <br />"perform an ongoing review of the city's master plan to include... holding public hearings and <br />making recommendations to the city council regarding updates to the land use... [element] at least <br />once every three years". <br /> <br />3. The City Council adopted the Sector One Plan on September 8, 1997. <br /> <br />4. The Planning and Zoning Commission held a public hearing on a revised Sector One Plan <br />on June 22, 2004 ,2004, and voted on June 22, 2004 to recommend the adoption of a revised <br />Sector One Plan by the City Council. <br /> <br />5. The City Council conducted a public hearing on the adoption of the revised Sector One <br />Plan on Allgll~J: q. ' 2004. <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: <br /> <br />SECTION 1. The Sector One Plan adopted by the City Council on September 8, 1997 is <br />repealed, and the revised Sector One Plan attached to this ordinance is adopted. <br /> <br />SECTION 2. If any word, phrase, clause, sentence, or paragraph of this ordinance is held to <br />be unconstitutional or invalid by a court of competent jurisdiction, the other provisions of this <br />ordinance will continue in force if they can be given effect without the invalid portion. <br /> <br />SECTION 3. All ordinances and resolution or parts of ordmances or resolutions in conflict <br />with this ordinance are repealed. <br /> <br />SECTION 4. Any person violating any provision of this ordinance commits a misdemeanor <br />and is subject to the penalty provided in Section 1.015 of the San Marcos City Code upon conviction. <br /> <br />SECTION 5. This ordinance will take effect ten days after the date of its final passage, and <br />
