<br /> <br />79 <br /> <br />ORDINANCE 1982-32 <br /> <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY <br />OF SAN MARCOS, TEXAS, APPROVING THE TERMS AND <br />CONDITIONS OF THE GRANT OF AN ELECTRIC LINE <br />EASEMENT AND RIGHT-OF-WAY TO THE LOWER COLORADO <br />RIVER AUTHORITY FOR ELECTRIC TRANSMISSION AND/ <br />OR DISTRIBUTION LINES AND ALL NECESSARY OR <br />DESIRABLE APPURTENANCES~ AUTHORIZING THE MAYOR <br />TO EXECUTE SAID ELECTRIC LINE EASEMENT AND <br />RIGHT OF WAY AND DECLARING AN EMERGENCY. <br /> <br />WHEREAS, the Lower Colorado River Authority has a present <br />need to place electric transmission and/or distribution lines <br />and certain necessary or desirable appurtenances over, on and <br />under certain land owned by the City of San Marcos, Texas; and, <br /> <br />WHEREAS, the City Council of the City of San Marcos, Texas, <br />desires to grant an electric line easement and right-of-way on, <br />over, and under said certain City-owned land, to-wit: on, over, <br />and under a portion of the San Marcos Memorial Recreation Park <br />located in the vicinity of Bugg Lane; and, <br /> <br />WHEREAS, an appraisal of said easement has estimated the <br />decrease in value of said City-owned land by virtue of said grant <br />to be $500.00; now, therefore, <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br />SECTION 1. That that Electric Line Easement and Right-of- <br />Way granting to the Lower Colorado River Authority the right, <br />privilege and authority to construct, reconstruct, inspect, operate, <br />patrol, maintain and remove its electric transmission and/or <br />distribution lines and all necessary or desirable appurtenances, <br />together with the right of ingress and egress over the easement <br />premises and the right to remove from said lands all trees and <br />parts thereof which endanger or may interfere with the efficiency <br />of said lines or their appurtenances, a copy of which instrument <br />is attached hereto and incorporated herein for all intents and <br />purposes, be, and the same is hereby, approved in all respects. <br /> <br />SECTION 2. That the Mayor of the City of San Marcos, Texas, <br />Emmie Craddock, be, and she is hereby, authorized to execute said <br />instrument conveying said easement. <br /> <br />SECTION 3. That the importance of this Ordinance creates <br />an emergency and an imperative purpose necessary that the provisions <br />of the charter requiring that ordinances shall be read at three <br />separate meetings and that no ordinance shall become effective <br />until the expiration of ten (10) days following the date of its <br />final passage be suspended, and these provisions are hereby sus- <br />pended, and this Ordinance shall take effect and be in full force <br />and effect from and after its adoption and publication in a news- <br />paper of general circulation within the City. <br /> <br />PASSED, APPROVED, AND ADOPTED this 26th day of <br /> <br />July <br /> <br />, 1982. <br /> <br /> <br /> <br />Emmie Craddock <br />Mayor <br /> <br /> <br />s K.
