156 RESOLUTION NO. 1982-41R A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN ~ffiRCOS, TEXAS, APPROVING THE TERMS AND CONDITIONS OF A FIRE PROTECTION AGREEMENT BETWEEN SAID CITY AND HAYS COUNTY FOR THE PROVISION OF FIRE PROTECTION TO PERSONS AND PROPERTY LOCATED IN HAYS COUNTY AND OUTSIDE THE CORPORATE LI~1ITS OF THE CITY OF SAN ~RCOSi AUTHORIZING THE }ffiYOR OF SAID CITY TO EXECUTE SAID AGREEMENT ON BEHALF OF SAID CITY AND DECLARING AN EFFEC- TIVE DATE. WHEREAS, there exists the need to provide fire protection to certain areas of Hays County, those areas being the areas located outside the corporate limits of the City of San Marcos and not provided with fire protection services other than those previously provided by CitYi and, WHEREAS, the City of San Marcos and the County of Hays agree that said fire protection services for said areas should be pro- vided pursuant to the terms and conditions of the attached Fire Protection Agreementi and, WHEREAS, the City of San Marcos and the County of Hays may enter into such an agreement for this provision of governmental functions and services pursuant to authority of the Texas Inter- local Cooperation Act, Art. 4413(32c), TEX.REV.CIV.STAT.i now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN ~RCOS, TEXAS: PART 1. That the Fire Protection Agreement between the City of San Marcos, Texas, and Hays County, Texas, for the provision of fire protection services in certain areas of Hays County, a copy of which is attached hereto and incorporated herein for all intents and purposes, be, and the same is here- by approved in all respects. PART 2. That the ~1ayor of the City of San Marcos, Emmie Craddock, is hereby authorized to execute said Fire Protection Agreement on behalf of said City. PART 3.
