<br />A RESOLUTION OF THE CITY COUNCIL OF THE
<br />CITY OF SAN MARCOS, TEXAS, APPROVING THE
<br />TERMS AND CONDITIONS OF A CONTRACT FOR COM-
<br />PUTER HARDWARE AND SOFTWARE; A SOFTWARE
<br />MAINTENANCE AGREEMENT AND A LICENSE AGREE-
<br />MENT BETWEEN SAID CITY AND HMS,INC., A
<br />GEORGIA CORPORATION; AUTHORIZING THE MAYOR
<br />OF SAID CITY TO EXECUTE SAID CONTRACT, SAID
<br />MAINTENANCE AGREEMENT AND SAID LICENSE
<br />AGREEMENT AND DECLARING AN EFFECTIVE DATE
<br />
<br />WHEREAS, the City Council of the City of San Marcos,
<br />Texas, desires to provide for the present and future data
<br />processing needs of the City of San Marcos, Texas; and,
<br />
<br />WHEREAS, on July 15, 1982, said City submitted a
<br />Request for Proposal For Automated Management Information
<br />Systems to solicit proposals for computer hardware and
<br />software; and,
<br />
<br />WHEREAS, notice of said Request was published in the
<br />San Marcos Daily Record on July 8, 1982, and July 15, 1982;
<br />and,
<br />
<br />WHEREAS, a pre-bid conference was held on July 23,
<br />1982; and,
<br />
<br />WHEREAS, a committee composed of A.C. Gonzalez, City
<br />Manager; Earl Williams, Director of Finance; and Don Laine,
<br />C.P.A. of Harold V. Simpson & Company examined proposals
<br />submitted in response to said Request; and,
<br />
<br />WHEREAS, on September 27, 1982, said committee recom-
<br />mended that the needed data processing equipment be pur-
<br />chased from HMS, Inc., a Georgia corporation with principal
<br />offices at 2700 Delk Road, Suite 200, Marietta, Georgia,
<br />30067; and,
<br />
<br />WHEREAS, on September 27, 1982, the City Council of
<br />the City of San Marcos, Texas, voted to enter into a letter
<br />agreement with HMS, Inc.; and,
<br />
<br />WHEREAS, said Council hereby finds and determines that
<br />the Proposal of HMS, Inc. would provide equipment which would
<br />best serve the needs of said City; now, therefore,
<br />
<br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN
<br />MARCOS, TEXAS:

<br />PART 1. That the terms and conditions of the Contract
<br />For Computer Hardware and Software, the Software Maintenance
<br />Agreement and the License Agreement between the City of San
<br />Marcos, Texas and HMS, Inc., a Georgia corporation, copies
<br />of which Contract, Maintenance Areement and License Agree-
<br />ment are attached hereto and incorporated herein for all
<br />intents and purposes, be, and the same are hereby approved
<br />in all respects.
