44 RESOLUTION 1982-54R A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN ~ffiRCOS, TEXAS, APPROVING THE TERMS AND CONDITIONS OF AMENDMENT NO. 3 TO THAT CONTRACT OF MAY 7, 1980, BETWEEN SAID CITY AND FREESE AND NICHOLS, INC. FOR THE PROVISION OF ENGINEERING SERVICES CON- NECTED WITH WASTEWATER SYSTEM IMPROVEMENTS IN SAID CITY; AUTHORIZING THE CITY ~ffiNAGER OF SAID CITY TO EXECUTE SAID N1ENDMENT NO. 3 AND DECLARING AN EFFECTIVE DATE. WHEREAS, the City of San Marcos, Texas, entered into a contract with Freese and Nichols, Inc., on May 7, 1980, for the provision of engineering services in connection with pro- posed improvements to the City's wastewater collection system; and, WHEREAS, said Contract has subsequently been amended on May 19, 1980 and August 3, 1982,; and, WHEREAS, the City Council of said City wishes to further amend said Contract; now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: PART 1. That the terms and conditions of Amendment No. 3 To Contract For Engineering Services, said contract entered into on May 7, 1980 by the City of San Marcos, Texas, and Freese and Nichols, Inc., a copy of which Amendment No.3 is attached here- to and incorporated herein for all intents and purposes, be, and the same are hereby, approved in all respects. PART 2. That the City Manager of the City of San Marcos, Texas, A.C. Gonzalez, be, and he is hereby, authorized to execute said Amendment No. 3 To Contract For Engineering Services on be- half of said City. PART 3.
