<br /> <br />81 <br /> <br /> <br /> <br />ORDINANCE 1982-61 <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF <br />SAN MARCOS, TEXAS, AMENDING SECTION 3 OF THAT <br />ORDINANCE WHICH REGULATES AND RESTRICTS THE LO- <br />CATION AND USE OF BUILDINGS, STRUCTURES AND LAND, <br />DATED SEPTEMBER 29, 1980 (VOL. 54) BY ZONING <br />21.02 ACRES OF LAND, BEING TWO TRACTS OF LAND <br />CALLED BLOCK ONE AND BLOCKS TWO AND THREE, AND <br />BEING PART OF THAT 28-ACRE TRACT OF LAND CONVEYED <br />BY JACK PERKINS, ET UX, TO JOHN J. STOKES BY DEED <br />DATED NOVEMBER 28, 1956, AND RECORDED IN VOLUME <br />169, PAGE 375 OF THE HAYS COUNTY DEED RECORDS, <br />FROM "p" (PUBLIC USE) TO "R-l" (SINGLE-FAMILY <br />DWELLING DISTRICT) . <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: <br /> <br />SECTION 1. That the following described parcel of real property 10- <br /> <br />cated in San Marcos, Hays County, Texas, which is presently zoned <br /> <br />"p" (Public Use) henceforth shall be rezoned as follows: <br /> <br />21.02 acres of land, being two tracts of land called Block One and <br />Blocks Two and Three, and being part of that 28-acre tract of land <br />conveyed by Jack Perkins, Et Ux, to John J. Stokes by deed dated <br />Novewber 28, 1956, and recorded in Volume 169, Page 375 of the Hays <br />County Deed Records, and is more particularly described by metes <br />and bounds as follows; <br /> <br />TRACT ONE: BEGINNING at an iron rod found for the north corner of <br />this tract and the west corner of a 1.82 acre tract of land conveyed <br />by John J. Stokes to Roy Perkins, Et AI, by deed dated March 24, 1969, <br />and recorded in Volume 229, Page 629 of the Hays County Deed Records <br />on the southeast line of Franklin Street; <br /> <br />THENCE with the southwest line of the 1.82 acre Perkins tract S. 460 <br />40' E. 204.84 feet to an iron rod found for the south corner of the <br />1.82 acre Perkins tract and a west corner of the San Marcos City Ceme- <br />tery tract; <br /> <br />THENCE with a southwest line as fenced of the San Marcos City Ceme- <br />tery the following three calls: <br /> <br />1. S. 460 21' E. 449.32 feet to a railroad tie for a fence <br />corner, <br />2. S. 410 50' W. 78.40 feet to a fence corner post, and <br />3. S. 430 53' E. 199.08 feet to a concrete fence corner <br />post for the east corner of this tract and a re-entrant corner of the <br />San Marcos City Cemetery; <br /> <br />THENCE with a northwest line of the San Marcos City Cemetery as fenced <br />S. 510 31' W. 457.34 feet to a point for the south corner of this tract <br />on the northeast line of Perkins Street, a public street; <br /> <br />THENCE with the northeast line of Perkins Street the following three <br />calls: <br /> <br />1. N. 460 59' W. 193.53 feet, <br />2. N. 450 50' W. 258.44 feet to a point for the point of <br />curvature of a right breaking curve, and <br />3. With a right breaking curve having the following char- <br />- acteristics: central angle 210 50' 24", radius 957.44 feet, tangent <br />length 184.72 feet, arc length 364.96 feet, and a chord whose bearing <br />and distance are N. 340 55' W. 362.75 feet to a point for the west <br />corner of this tract on the southeast line of Franklin Street; <br />
