<br />121 <br /> <br />RESOLUTION NO. 1980-26BR <br /> <br />I <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE <br />CITY OF SAN MARCOS, TEXAS, TERMINATING A <br />CONTRACT BETWEEN SAID CITY AND S.A. <br />GARZA ENGINEERS, INC. OF AUSTIN, TEXAS <br />FOR ENGINEERING SERVICES PERTAINING TO <br />PAVING IHPROVEMENTS TO BE MADE TO ARM- <br />STRONG STREET AND ALABAMA STREET IN <br />SAID CITY AND DECLARING AN EFFECTIVE <br />DATE. <br /> <br />WHEREAS, the City of San Marcos, Texas, entered into an <br />engineer agreement with S.A. Garza Engineers, Inc. of Austin, <br />Texas, on June 4, 1979 for the provision of professional en- <br />gineering services in connection with the Centre Street Recon- <br />struction Project, and the Roosevelt Street/Patton Street Project; <br />and, <br /> <br />WHEREAS, the City Council of said city approved a supple- <br />mental engineer agreement with S.A. Garza Engineers, Inc. of <br />Austin Texas, on December 27, 1979; for improvements to Armstrong Stree <br />and Alabama Street; and, <br /> <br />WHEREAS, S.A. Garza was not notified of said approval and, <br />as a result, finds his firm cannot accomplish the work specified <br />by the dates agreed upon by the parties; and, <br /> <br />WHEREAS, the funding for the third year of the Community <br />Development Small Cities Program by the United States Department <br />of Housing and Urban Development may be jeopardized if the second <br />year funds are not utilized; and, <br /> <br />I <br /> <br />WHEREAS, said project of improvements to Armstrong and Alabama <br />Streets is funded by funds designated for the second year of the <br />Community Development Small Cities Program; and, <br /> <br />WHEREAS, the City Council of said city determines that it <br />is to the mutual benefit of both parties for said agreement to <br />be terminated; now, therefore, <br /> <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br />PART 1. That the engineer agreement, entered into on June 4, <br />1979 including the supplemental engineer agreement approved by <br />the city council on December 27, 1979, between the City of San <br />Marcos, Texas and S.A. Garza Engineers, Inc. of Austin, Texas, <br />said agreement for the provision of engineerinq services relating <br />to the Centre Street Reconstruction Project and the Roosevelt <br />Street/Pattton Street Project and, in addition, the improvements <br />of Armstrong Street and Alabama Street, be, and the same is here- <br />by terminated. <br /> <br />PART 2.
