47 RESOLUTION No. 1980-44R A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, ORDERING THAT A SPECIAL CITY ELECTION BE HELD ON SA'I'URDAY, AUGUST 9, 1980, FOR THE PURPOSE OF ELECTING A COUNCIL MEMBER FOR PLACE FOUR; AND DECLARING AN EFFECTIVE DATE. I WHEREAS, Gilbert G. Tenorio, Council Member Place Four, has tendered his resignation as Council Member to the Mayor of the City of San Marcos, Texas; and WHEREAS, with the effective date of said resignation, June 23, 1980, Mr. Tenorio did hold the office of Council Member, said office carrYlng a term of three years and expiring in April of 1981; and WHEREAS, it is now necessary to fill the unexpired term for Council Member Place Four as provided for in Sec. 3.06 of the San Marcos City Charter; now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: SECTION 1. That a special election be held in said City on the 9th day of August, 1980, to elect a Council Member Place 4. Section 2. That the ballot for said special election contain the following proposition for election of a Council Member: COUNCIL MEMBER, PLACE FOUR (unexpired term). I SECTION 3. That Doriss Hambrick is hereby appointed Clerk for absentee voting and said Clerk is authorized to designate such Deputy Clerks as may be necessary for the conduct of absentee voting. The absentee voting shall be held at City Hall within said City and said place of absentee voting shall remain open for at least eight hours on each day for absentee voting which is not a Saturday, a Sunday, or an official State holiday, beginning on the 20th day and continuing through the fourth day preceding the date of said election. Said place of voting shall remain open between the hours of 8:00 a.m. and 5:00 p.m. on each day for said absentee voting. The above described place for absentee voting is also the absentee clerk's mailing address to which ballot applications and ballots voted by mail may be sent. SECTION 4. That all independent candidates at the election to be held on the 9th day of August, 1980, for the above mentioned office shall file their applications to become candidates for Place 4 with the City Secretary of this City at City Hall, on or before 5:00 p.m. on the 31st day preceding the election date. SECTION 5. That all of said applications shall be substantially in the following form: "To the City Secretary of the City of San Marcos" Texas: I I hereby request that my name be placed upon the official ballot for the election to be held on the 9th day of August, 1980, as a candidate for Place 4 Council Member of said City. i hereoy certify that I am above the age of 18 years, a qualified elector and have resided 12 months next preceding said election in said City, and I am eligiole to hold office under the Constitution of this State.
