<br />164 <br /> <br />RESOLUTION 1999- ~R <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS EXPRESSING THE CITY'S OPPOSITION TO CERTAIN LEGISLATION <br />PENDING IN THE 76TH TEXAS LEGISLATURE, AND DECLARING AN <br />EFFECTIVE DATE. <br /> <br />WHEREAS, the City Council wishes to express the City's opposition to certain legislation <br />pending in the 76tb Texas Legislature; now, therefore <br /> <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS. TEXAS: <br />PART 1. The City of San Marcos OPPOSES the following legislation: <br /> <br />1. H.B. 2935 (Corte)-Extending Private Real Property Rights Protection Act to zoning <br />and other municipal actions <br /> <br />2. H.B. 3241 (Green)-Restricting the ability of cities to construct or enlarge recreational <br />facilities <br /> <br />3. S.B. 793 (Nixon)-AlIowing neighborhood areas adjacent to a city to incorporate <br />without city consent <br /> <br />4. S.B. 1264 (Madla)-Limiting city regulation of, and fees charged for use of, rights-of- <br />way <br /> <br />5. S.B. 441 (Ellis )-Creating a "holiday" from city, as well as state, sales taxes <br /> <br />PART 2. The positions expressed in this resoluti~n apply to the most recent versions of the <br />bills as of the date of this resolution. These positions are subject to change as the legislative <br />session progresses and revisions are made to the bills. <br /> <br />PART 3.
