<br />:lllE <br />~ <br />:q <br />~. <br /> <br />~ ~I <br /> <br />I"l'\ 0:: <br />N ~j <br />cr: l= 1J, <br />~ 01 <br /> <br />12. <br /> <br />ORDINANCE 1999-~ <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF <br />SAN MARCOS, TEXAS, AMENDING THE OFFICIALZONING <br />MAP OF THE CITY BY REZONING LOT 25 OF THE SOUTH <br />END ADDITION LOCATED AT 508 ALABAMA STREET <br />FROM "M" SINGLE-FAMILY, DUPLEX AND <br />NEIGHBORHOOD BUSINESS DISTRICT TO "R-2" SINGLE- <br />FAMILY DWELLING DISTRICT (MEDIUM DENSITY); <br />INCLUDING PROCEDURAL PROVISIONS; AND PROVIDING <br />FOR PENALTIES. <br /> <br />RECITALS: <br /> <br />1. On April 13, 1999, the Planning and Zoning Commission of the City of San <br />Marcos held a public hearing regarding a request to change the zoning from "M" Single- <br />Family, Duplex and Neighborhood Business District to "R_2" Single-Family Dwelling District <br />(Medium Density) for Lot 25 of the South End Addition located at 508 Alabama Street. <br /> <br />2. Subsequent to the public hearing on that date, the Planning and Zoning <br />Commission did, on April 13, 1999 consider and vote to approve the request, and has <br />recommended that the request be approved by the City Council of the City. <br /> <br />3. The City Council held a public hearing on the 24th <br />May , 1999, regarding the request. <br /> <br />day of <br /> <br />4. All requirements of Chapter 114, Zoning, ofthe San Marcos City Code pertaining <br />to zoning map amendments have been met. <br /> <br />5. The City Council hereby finds and determines that the adoption of the following <br />ordinance is in the interest of the public health, morals, welfare and safety. <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br />SECTION 1. The Official Zoning Map of the City, as described in Section 114.029 <br />of the San Marcos City Code, is amended to rezone the following real property which is <br />presently zoned "M" Single-Family, Duplex and Neighborhood Business District to "R-2" <br />Single Family Dwelling District (Medium Density): <br /> <br />Street address: <br /> <br />508 Alabama Street. <br /> <br />Legal description: Lot 25 of the South End Addition. <br /> <br />Deed or plat reference: Volume 55, pages 600-601, Hays County Deed Records. <br /> <br />SECTION 2. Any person violating any provision of this ordinance commits a <br />misdemeanor and is subject to the penalty provided in Section 1.015 of the San Marcos <br />City Code upon conviction. <br /> <br />SECTION 3. After its original passage, this ordinance will be subject to <br />reconsideration at the next regular City Council meeting. If this ordinance is not <br />reconsidered, or if it is reconsidered and approved, notice of its adoption will be published <br />in a newspaper of general circulation in the City. This ordinance will take effect upon <br />publication of this notice. <br /> <br />PASSED, APPROVED AND ADOPTED this 24 day of May ,1999, <br />subject to reconsideration at the next regular City Council meeting scheduled for <br />June 14, 1999. <br /> <br />Reconsidered yes <br /> <br />no x <br />
