On October 12, 1999 , the Planning and Zoning Commission of the City of San <br />Marcos held a public hearing regarding a request to change the zoning from "PD" Pre- <br />Development District to "C" Commercial District for a 2.097 acre tract of property located <br />at 2104 and 2106 Hunter Road. <br /> <br />2. Subsequent to the public hearing on that date, the Planning and Zoning <br />Commission did, on October 12, 1999 consider and vote to approve the request, and has <br />recommended that the request be approved by the City Council of the City. <br /> <br />3. The City Council held a public hearing on the 13th day of <br />December , 1999, regarding the request. <br /> <br />4. All requirements of Chapter 114, Zoning, of the San Marcos City Code pertaining <br />to zoning map amendments have been met. <br /> <br />5. The City Council hereby finds and determines that the adoption of the following <br />ordinance is in the interest of the public health, morals, welfare and safety. <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br />SECTION 1. The Official Zoning Map of the City, as described in Section 114.029 <br />of the San Marcos City Code, is amended to rezone the following real property which is <br />presently zoned "PD" Pre-Development District to "C" Commercial District: <br /> <br />Street address: <br /> <br />2104 and 2106 Hunter Road <br /> <br />Size: 2.097 acres. <br /> <br />Legal description: See the metes and bounds description attached as Exhibit A. <br /> <br />Deed or plat reference: Volume 267, page 771, Hays County Deed Records. <br /> <br />SECTION 2. Any person violating any provision of this ordinance commits a <br />misdemeanor and is subject to the penalty provided in Section 1.015 of the San Marcos <br />City Code upon conviction. <br /> <br />SECTION 3. After its original passage, this ordinance will be subject to <br />reconsideration at the next regular City Council meeting. If this ordinance is not <br />reconsidered, or if it is reconsidered and approved, notice of its adoption will be published <br />in a newspaper of general circulation in the City.
