<br />I <br /> <br />I <br /> <br />I <br /> <br />RESOLUTION 2006- 136 R <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, APPROVING A MEMORANDUM OF AGREEMENT WITH THE <br />U.S. DEPARTMENT OF TRANSPORTATION, FEDERAL AVIATION <br />ADMINISTRATION FOR THE CONSOLIDATION OF CURRENT LAND <br />LEASE AGREEMENTS INVOLVING THE SAN MARCOS MUNICIP AL <br />AIRPORT; AUTHORIZING THE CITY MANAGER TO EXECUTE THIS <br />AGREEMENT ON BEHALF OF THE CITY AND DECLARING AN <br />EFFECTIVE DATE. <br /> <br />RECITALS: <br /> <br />1. The U.S. Department of Transportation - Federal Aviation Administration (the <br />"FAA") currently maintains and operates six aviatio_. ~Jmmunication, navigation and weather <br />aids at the San Marcos Municipal Airport for the support of air traffic operations under three <br />separate land lease agreements with the City. <br /> <br />2. It is the desire of both the FAA and the City to streamline the process and reduce <br />paperwork by consolidating these land lease agreements into one Memorandum of Agreement. <br /> <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br />PART 1. The attached Memorandum of Agreement between the FAA and the City <br />consolidating three separate land lease agreements, which provide for the construction operation <br />and maintenance of air traffic operations at the San Marcos Airport, into one agreement, is <br />approved. <br /> <br />PART 2. This agreement succeeds current FAA Lease #DTFA07-85-L-OI095 and <br />supersedes Lease #DTFA07-89-L-01202 and #DTFA07-01-L-01300. <br /> <br />PART 3. The City Manager, Dan O'Leary, is authorized to execute the <br />Memorandum of Agreement on behalf of the City. <br /> <br />PART 4. <br />after its passage. <br /> <br />This Resolution shall be in full force and effect immediately from and <br /> <br />ADOPTED this the 5th <br /> <br />day of September, <br /> <br />2006. <br /> <br />~a~~ <br /> <br />Mayor <br />
