I ORDINANCE NO. 2006- 64 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MAROCS, TEXAS, APPROVING AN AMENDMENT TO THE FUTURE LAND USE MAP FROM uHr' HEAVY INDUSTRIAL DISTRICf TO "HC" HEA VY COMMERCIAL DISTRICT, FOR AN 8.22 ACRE, MORE OR LESS, TRACT OF LAND LOCATED AT 1942 IH-35 SOUTH; FOR AMENDING THE OFFICIAL ZONING MAP OF THE CITY BY REZONING THIS TRACT FROM "HI" HEAVY INDUSTRIAL DISTRICT TO "HC" HEA VY COMMERCIAL DISTRICT; INCLUDING PROCEDURAL PROVISIONS; AND PROVIDING FOR PENALTIES. REcrr ALS: 1. On October 24, 2006, the City Planning and Zoning Commission of the City of San Marcos held a public hearing regarding a request to change the Future Land Use Map of the San Marcos Horizons City Ma:J"ter Plan from "HI" Heavy Industrial District to "HC' Heavy Commercial District for an 8.22 acre, more or less, tract of land located at 1942 IH-35 South. 2. Subsequent to the public hearing on that date, the Planning and Zoning Commission considered and voted to approve the requests on October 24, 2006, and recommended that the requests be approved by the City Council. I 3. The City Council held a public hearing on December 11,2006. , regarding the requests. 4. All requirements of Chapler 1, Development Procedures, of the City Land Development Code pertaining to Future Land Use Map Amendments and Zoning Map amendments ha ve been met. 5. The City Council hereby finds and determines that the adoption of [he following ordinance is in the interest of the public heahh, morals, welfare and safety. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS. TEXAS: SECTION 1. The Future Land Use Plan of the San Marco.~ Horizons City Master Plan is revised to change lhe future land use designation from "H)" Heavy Industrial District to "HC" Heavy Commercial District Street address: 1942 IH-35 South.
