RESOLUTION NO. 2012 -123R <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS AUTHORIZING THE CITY MANAGER TO <br />NEGOTIATE THE TERMS AND CONDITIONS OF A <br />DEVELOPMENT AGREEMENT SUBMITTED BY WALTON TEXAS, <br />L.P., A TEXAS LIMITED PARTNERSHIP, AND WALTON <br />INTERNATIONAL GROUP, (USA), INC, AN ARIZONA CORPORATION <br />FOR COTTON CENTER, AN APPROXIMATELY 1,206 ACRE <br />MASTER PLANNED MIXED -USE DEVELOPMENT LOCATED IN <br />CALDWELL COUNTY WITHIN THE CITY'S <br />EXTRATERRITORIAL JURISDICTION; AND DECLARING AN <br />EFFECTIVE DATE. <br />RECITALS: <br />I . Cotton Center is a master- planned mixed use community located at the northeast <br />corner of San Marcos Highway (HWY) 80 and FM 1984 approximately 1.7 miles southeast of <br />the San Marcos Municipal Airport, seven (7) miles east of Texas State University and ten (10) <br />miles east of the San Marcos Outlet Malls. in Caldwell County ( "Property ") outside of the City <br />limits, but within the City's extraterritorial jurisdiction. Walton Texas, L.P., a Texas limited <br />partnership, and Walton International group, (USA), Inc, an Arizona corporation ( "Owner ") are <br />the owners of the Property. <br />2. The purpose of a development agreement is to define, protect and clarify a plan of <br />development for the Property, to prescribe land uses, environmental standards, development <br />standards and public facilities standards which will provide increased certainty to Owner and <br />City in accordance with the objectives and requirements of the City's Land Development Code. <br />3. The proposed development plans to extend water and wastewater utilities to the <br />Property through the creation of a municipal utility district under Chapters 49 and 54 of the <br />Texas Water Code. <br />4. On September 11, 2012, the Planning and Zoning Commission held a public <br />hearing to authorize the staff to negotiate a Development Agreement. Subsequent to the public <br />hearing, on the same date, the Planning and Zoning Commission voted to approve staff <br />commencing negotiations with the Owner for the development agreement. <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br />PART 1. The City Manager is authorized to negotiate the terms and conditions of a <br />development agreement with the Owner of the Property that are consistent with the purposes and <br />objectives established in Chapters 1 and 2 the San Marcos Land Development Code. <br />1 <br />
