79, <br /> <br />RESOLUTION NO. 2003 - 85 R <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS APPROVING AN INTERLOCAL COOPERATION CONTRACT <br />BETWEEN THE CITY AND THE TEXAS DEPARTMENT OF PUBLIC <br />SAFETY FOR IMPLEMENTATION OF THE "FAILURE TO APPEAR" <br />PROGRAM DENYING DRIVER'S LICENSE RENEWAL FOR FAILURE TO <br />APPEAR IN MUNICIPAL COURT; PROVIDING FOR THE CHARGING OF <br />AN ADMINISTRATIVE FEE; AUTHORIZING THE CITY MANAGER TO <br />EXECUTE THE CONTRACT ON BEHALF OF THE CITY; AND DECLARING <br />AN EFFECTIVE DATE. <br /> <br />RECITALS: <br /> <br /> 1. Chapter 706 of the Texas Transportation Code allows political subdivisions to contract <br />with the Texas Department of Public Safety (TDPS) to deny renewal of the driver's license of a <br />person who unlawfully fails to appear in Municipal Court. The program is designed to motivate <br />persons charged with municipal court violations to adhere to their promise to appear in court. <br /> <br />2. The City desires to participate in this program through a contract with TDPS. <br /> <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CiTY OF SAN MARCOS, TEXAS: <br /> <br /> PART 1. The terms and conditions of the Interlocal Cooperation Contract between the <br />City and TDPS, a copy of which is attached and incorporated, are approved. <br /> <br /> PART 2. An administrative fee of $30.00 for each applicable offense reported under <br />the program is approved. <br /> <br /> PART 3. <br />behalf of the City. <br /> <br />The City Manager, Dan O'Leary, is authorized to execute the contract on <br /> <br /> PART 4. <br />adoption. <br /> <br />This Resolution shall be in full force and effect immediately from and after its <br /> <br />ADOPTEDon May 12, 2003. <br /> <br />Robert Habingreither <br />Mayor <br /> <br />Attest: .z/2~_ / ' <br />City Clerk <br /> <br /> <br />
