<br /> 129 <br /> RESOLUTION 1997 - 125 R <br /> A RESOLUTION OF THE CITY COUNCil OF THE CITY OF SAN MARCOS, <br /> TEXAS, APPROVING THE TERMS AND CONDITIONS OF A LICENSE <br /> AGREEMENT AUTHORIZING SOUTHWEST TEXAS STATE UNIVERSITY <br /> TO UTILIZE THE CITY PARK ATHLETIC FIELD FOR FOOTBAll <br /> PRACTICE AND PHYSICAL EDUCATION CLASSES; AUTHORIZING THE <br /> CITY MANAGER TO EXECUTE THE LICENSE AGREEMENT ON BEHALF <br /> OF THE CITY AND DECLARING AN EFFECTIVE DATE. <br /> RECITALS: <br /> 1. By resolution, approved by the City Council on April 8, 1996, the Mayor and City <br /> Manager were authorized to notify Southwest Texas State University (SWTSU) of <br /> the City's intent to terminate its license dated May 16, 1983, for use of the City <br /> Park athletic field. The license was terminated on May 10, 1996. <br /> 2. The new License Agreement attached to this resolution sets out in more detail the <br /> City's and SWTSU's respective responsibilities for the use, care and maintenance <br /> of the City Park athletic field. <br /> BE IT RESOLVED BY THE CITY COUNCil OF THE CITY OF SAN MARCOS, TEXAS: <br /> PART 1. The terms and conditions of the new License Agreement attached to <br /> this resolution under which Southwest Texas State University is authorized to utilize the <br /> City Park practice field are approved. <br /> PART 2. The City Manager, larry D. Gilley, is authorized to execute the <br /> attached License Agreement on behalf of the City. <br /> PART 3.
