\'- 15-' èJ 8 - - U""\ a ORDINANCE 1997- 67 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, CANVASSING RETURNS AND DECLARING RESULTS OF THE SPECIAL ELECTION HELD ON NOVEMBER 4, 1997 FOR THE PURPOSE OF SUBMITTING TO THE VOTERS A PROPOSITION REGARDING COLLECTIVE BARGAINING FOR POLICE OFFICERS; AND DECLARING AN EFFECTIVE DATE. RECITALS: 1. The City Council ordered that a Special election be held on November 4, 1997 for the purpose of submitting a proposition to the voters regarding collective bargaining for police officers. 2. Notice of this election was published in the San Marcos Daily Record on October 12, 1997. 3. A copy of the notice was posted on the bulletin board at City Hall on October 14, 1997. 4. This election was legally held on the 4th day of November, 1997, in conformity with the election laws of the State of Texas, and the results of the election have been certified and returned by the proper judges and clerks. 5. The City Council of the City of San Marcos, Texas with the following members present: Mayor Billy G. Moore, Ronald K. Hart, Fred Guerra, Jane Hughson, Joe B. Cox, Ed Mihalkanin, and Rick Hernandez has today considered the returns of the Special election held on the 4th of November, 1997. 6. It appears to the Council, and the Council finds, that the election was in all respects lawfully held. 7. It appears to the Council, and Council finds, that the tabulation of the results of the election is correct. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: SECTION 1. The Special election of November 4, 1997 was duly called, notice of the election was given in accordance with law, and the election was held in accordance with law. SECTION 2. The tabulation of votes cast in the Special election held on November 4, 1997 for the purposes stated in recital 1 above, a copy of which is attached to and made a part of this ordinance, is adopted as the official tabulation of the votes cast at the election, and the tabulation will be filed and recorded in the official records of the City of San Marcos as the official canvass of the election. SECTION 3. The official canvass of the returns ofthe election reflects the following: A. The following votes were cast for and against the following proposition: CITY OF SAN MARCOS PROPOSITION NO. ONE The adoption of the state law applicable to police officers that establishes collective bargaining if a majority of the affected employees favor representation by an employees association, preserves the prohibition against strikes and lockouts, and provides penalties for strikes and lockouts.
