<br />\'- <br />15-' <br />èJ 8 <br />- <br />- <br />U""\ <br />a <br /> ORDINANCE 1997- 67 <br /> <br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br /> MARCOS, TEXAS, CANVASSING RETURNS AND DECLARING <br /> RESULTS OF THE SPECIAL ELECTION HELD ON NOVEMBER 4, <br /> 1997 FOR THE PURPOSE OF SUBMITTING TO THE VOTERS <br /> A PROPOSITION REGARDING COLLECTIVE BARGAINING FOR <br /> POLICE OFFICERS; AND DECLARING AN EFFECTIVE DATE. <br /> RECITALS: <br /> 1. The City Council ordered that a Special election be held on November 4, 1997 for <br /> the purpose of submitting a proposition to the voters regarding collective bargaining for <br /> police officers. <br /> 2. Notice of this election was published in the San Marcos Daily Record on October <br /> 12, 1997. <br /> 3. A copy of the notice was posted on the bulletin board at City Hall on October 14, <br /> 1997. <br /> 4. This election was legally held on the 4th day of November, 1997, in conformity with <br /> the election laws of the State of Texas, and the results of the election have been certified <br /> and returned by the proper judges and clerks. <br /> 5. The City Council of the City of San Marcos, Texas with the following members <br /> present: Mayor Billy G. Moore, Ronald K. Hart, Fred Guerra, Jane Hughson, <br /> Joe B. Cox, Ed Mihalkanin, and Rick Hernandez <br /> has today considered the returns of the Special election held on the 4th of November, <br /> 1997. <br /> 6. It appears to the Council, and the Council finds, that the election was in all respects <br /> lawfully held. <br /> 7. It appears to the Council, and Council finds, that the tabulation of the results of the <br /> election is correct. <br /> BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br /> TEXAS: <br /> SECTION 1. The Special election of November 4, 1997 was duly called, notice of <br /> the election was given in accordance with law, and the election was held in accordance <br /> with law. <br /> SECTION 2. The tabulation of votes cast in the Special election held on November <br /> 4, 1997 for the purposes stated in recital 1 above, a copy of which is attached to and made <br /> a part of this ordinance, is adopted as the official tabulation of the votes cast at the <br /> election, and the tabulation will be filed and recorded in the official records of the City of <br /> San Marcos as the official canvass of the election. <br /> SECTION 3. The official canvass of the returns ofthe election reflects the following: <br /> A. The following votes were cast for and against the following proposition: <br /> CITY OF SAN MARCOS PROPOSITION NO. ONE <br /> The adoption of the state law applicable to police officers that establishes <br /> collective bargaining if a majority of the affected employees favor <br /> representation by an employees association, preserves the prohibition <br /> against strikes and lockouts, and provides penalties for strikes and lockouts. <br />
