ORDINANCE 2003- 39 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AMENDING THE OFFICIAL ZONING MAP OF THE CITY BY REZON1NG A PORTION OF LOTS 7 AND 8, BLOCK 7 OF THE D.S. COMBS ADDITION, LOCATED AT 602 VALLEY STREET FROM "M" SINGLE-FAMILY, DUPLEX AND NEIGHBORHOOD BUSINESS DISTRICT TO "R-2" SINGLE-FAMILY DWELLING DISTRICT (MEDIUM DENSITY); INCLUDING PROCEDURAL PROVISIONS; AND PROVIDING FOR PENALTIES. RECITALS: 1. On May 27, 2003, the Planning and Zoning Commission of the City of San Marcos held a public hearing regarding a request to change the zoning from "M" Single- Family, Duplex and Neighborhood Business District to "R~2" Single-Family Dwelling District (Medium Density), located at 602 Valley Street. 2. Subsequent to the public hearing on that date, the Plamfing and Zoning Commission did, on May 27, 2003 consider and vote to approve the request, and has recmm~ended that the request be approved by the City Council of the City. 3. The City Council held a public hearing on the 23rcl day of ,1-un~ ,2003, regarding the request. 4. Ali requirements of Chapter 114, Zoning, of the San Marcos City Code pertaining to zoning map amendments have been met. 5. The City Council hereby finds and determines that the adoption of the following ordinance is in the interest of the public health, morals, welfare and safety. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: SECTION I. The Official Zoning Map of the City, as described in Section 114.029 of the San Marcos City Code, is amended to rezone the following real property which is presently zoned "M" Single-Family, Duplex and Neighborhood Business District to "R-2" Single-Family Dwelling District (Medium Density): Street address: 602 Valley Street. Leaal description: A portion of Lots 7 & 8, Block 7, of the D.S. Combs Addition, a metes and bounds description of which is attached as Exhibit A. 175.
