<br /> 34 <br /> - <br /> RESOLUTION 1996 - wm <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY <br /> SAN MARCOS, TEXAS ARROVING AN EXTENSION LETTER' <br /> AGREEMENT WITH THE UNION PACIFIC RAILROAD TO <br />; RENEW A LICENSE AGREEMENT FOR A 12 INCH WATER <br /> LINE LOCATED WITHIN RAILROAD PROPERTY; AND <br /> DECLARING AN EFFECTIVE DATE. <br /> RECITALS: <br /> 1. On October 1,1986 the City entered into a License Agreement with M-K-T <br /> Railroad for a 12 inch water line, the term of which will expire on September 3, 1996. <br /> 2. Union Pacific Railroad, M-K-T Railroad's successor, has requested that the <br /> City execute an Extension Letter Agreement which would extend the terms of the current <br /> agreement for an indefinite period commencing on October 1, 1996. <br /> . <br /> BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br /> TEXAS: <br /> PART 1. The Extension Letter Agreement attached to this resolution between <br /> the City and Union Pacific Railroad is approved. <br /> PART 2. The execution of the Agreement by the City Manager, Larry D. Gilley, <br /> is approved. <br /> PART 3. This Resolution shall be in full force and effect from and after its <br /> passage. <br /> ADOPTED this 20th day of May 1996. <br /> TJ~~.~ <br /> Billy G.
