LUO) <br />="', ~ cr; - ORDINANCE 1 995-~ <br /> '-~ :a: ... do <br />~i ~ ¡:::b <br />~-_. - Ss AN ORDINANCE OF THE CITY COUNCil OF THE CITY OF <br /> SAN MARCOS, TEXAS, AMENDING THE OFFICIAL ZONING <br /> MAP OF THE CITY BY REZONING A 3.45 ACRE TRACT OF <br /> PROPERTY, LOCATED AT 1221 THORPE LANE FROM "M" <br /> SINGLE-FAMILY, DUPLEX AND NEIGHBORHOOD <br /> BUSINESS DISTRICT TO "C" COMMERCIAL DISTRICT AND <br />i DECLARING AN EFFECTIVE DATE. <br /> RECITALS: <br /> 1. On March 14, 1995 the Planning and Zoning Commission of the City of San <br /> Marcos held a public hearing regarding a request to change the zoning from "M" Single- <br /> Family, Duplex and Neighborhood Business District to "C" Commercial District for a 3.45 <br /> acre tract of property located at 1221 Thorpe lane. <br /> 2. Subsequent to the public hearing on that date, the Planning and Zoning <br /> Commission did, on March 14, 1995, consider the request and voted to appíOve and has <br /> recommended that the request be approved by the City Council of the City. <br /> 3. The City Council held a public hearing on thé 24th day of <br /> April , 1995, regarding the request. <br /> 4. All requirements of Appendix A, General Zoning Ordinance, of the Code of <br /> Ordinances of the City of San Marcos pertaining to amendments have been met. <br /> 5. The City Council finds and determines that the adoption of the following <br /> ordinance is in the interest of the public health, morals, welfare and safety. <br /> BE IT ORDAINED BY THE CITY COUNÇll OF THE CITY OF SAN MARCOS, <br /> TEXAS: <br /> SECTION 1. That the Official Zoning Map of the City, as described in Section 3 of <br /> the General Zoning Ordinance, is amended to rezone the following real property which is <br /> presently zoned "M" Single-Family, Duplex and Neighborhood Business District to "C" <br /> Commercial District: <br /> Street address: 1221 Thorpe Lane. <br /> Size: 3.45 acres. <br /> leaal description: See attached Exhibit A. <br /> Deed or plat reference: Volume 135, Page 34, Hays County Deed Records. <br /> SECTION 2. That this Ordinance shall be in effect ten (10) days from and after its <br /> passage and after it has been subject to reconsideration by the Council at its next regular <br /> meeting following its passage, and provided that the Council did not vote to reconsider it. <br /> If reconsidered on May 8, 1995 it shall be in effect ten days from and <br />I after its passage on that date if approved. It shall not go into effect if denied. If not <br /> reconsidered and approved it shall be published in a newspaper of general circulation in <br /> the area as required by the Charter of the City of San Marcos, Texas. <br /> . <br /> PASSED, APPROVED AND ADOPTED this 24 day of April , 1995, subject <br /> to reconsideration at the next regular City Council meeting scheduled for May 8, 1995. <br />
