LUO) ="', ~ cr; - ORDINANCE 1 995-~ '-~ :a: ... do ~i ~ ¡:::b ~-_. - Ss AN ORDINANCE OF THE CITY COUNCil OF THE CITY OF SAN MARCOS, TEXAS, AMENDING THE OFFICIAL ZONING MAP OF THE CITY BY REZONING A 3.45 ACRE TRACT OF PROPERTY, LOCATED AT 1221 THORPE LANE FROM "M" SINGLE-FAMILY, DUPLEX AND NEIGHBORHOOD BUSINESS DISTRICT TO "C" COMMERCIAL DISTRICT AND i DECLARING AN EFFECTIVE DATE. RECITALS: 1. On March 14, 1995 the Planning and Zoning Commission of the City of San Marcos held a public hearing regarding a request to change the zoning from "M" Single- Family, Duplex and Neighborhood Business District to "C" Commercial District for a 3.45 acre tract of property located at 1221 Thorpe lane. 2. Subsequent to the public hearing on that date, the Planning and Zoning Commission did, on March 14, 1995, consider the request and voted to appíOve and has recommended that the request be approved by the City Council of the City. 3. The City Council held a public hearing on thé 24th day of April , 1995, regarding the request. 4. All requirements of Appendix A, General Zoning Ordinance, of the Code of Ordinances of the City of San Marcos pertaining to amendments have been met. 5. The City Council finds and determines that the adoption of the following ordinance is in the interest of the public health, morals, welfare and safety. BE IT ORDAINED BY THE CITY COUNÇll OF THE CITY OF SAN MARCOS, TEXAS: SECTION 1. That the Official Zoning Map of the City, as described in Section 3 of the General Zoning Ordinance, is amended to rezone the following real property which is presently zoned "M" Single-Family, Duplex and Neighborhood Business District to "C" Commercial District: Street address: 1221 Thorpe Lane. Size: 3.45 acres. leaal description: See attached Exhibit A. Deed or plat reference: Volume 135, Page 34, Hays County Deed Records. SECTION 2. That this Ordinance shall be in effect ten (10) days from and after its passage and after it has been subject to reconsideration by the Council at its next regular meeting following its passage, and provided that the Council did not vote to reconsider it. If reconsidered on May 8, 1995 it shall be in effect ten days from and I after its passage on that date if approved. It shall not go into effect if denied. If not reconsidered and approved it shall be published in a newspaper of general circulation in the area as required by the Charter of the City of San Marcos, Texas. . PASSED, APPROVED AND ADOPTED this 24 day of April , 1995, subject to reconsideration at the next regular City Council meeting scheduled for May 8, 1995.
