<br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
<br />SAN MARCOS, TEXAS, CANVASSING RETURNS AND
<br />DECLARING RESULTS OF THE SPECIAL AND GENERAL
<br />ELECTION HELD ON MAY 6,1995 FOR THE PURPOSE OF
<br />ELECTING A CITY COUNCIL MEMBER, PLACE ONE, AND' I
<br />A CITY COUNCIL MEMBER, PLACE TWO; AND i
<br />DECLARING AN EMERGENCY. !

<br />RECITALS:
<br />
<br />;
<br />
<br />1. The City Council ordered that a Special and General election be held on May' 6,
<br />1995 for the purpose of electing a City Council Member, Place One and a City Cou~cil
<br />Member, Place Two, :
<br />
<br />2. Notice of this election was duly published in the San Marcos Daily Record on April
<br />9,1995. '
<br />
<br />3. Copies of this notice were duly posted at each city election precinct polling pla'ce
<br />prior to the election, and a copy of the notice was posted on the bulletin board at City Hall
<br />on March 28, 1995.
<br />
<br />4. This election was duly and legally held on the 6th day of May, 1995, in conformity
<br />with the election laws of the State of Texas, and the results of the election have be,en
<br />certified and returned by the proper judges and clerks, I
<br />
<br />5. The City Council of the City of San Marcos, Texas with the following members
<br />present: Kathy M. Morris, Ronald K. Hart, Fred Guerra, Joe B. Cox, Jr.,
<br />Robert Mooney, Rick Hernandez and ~illy G. Moore
<br />and has today considered the returns of the Special and General election
<br />held on the 6th day of May, 1995,
<br />
<br />6. It appears to the Council, and the Council finds, that the election was in all respects
<br />lawfully held.
<br />
<br />7. It appears to the Council, and the Council finds, that the tabulation of the results of
<br />the election is correct.
<br />
<br />BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF SAN
<br />MARCOS, TEXAS:
<br />
<br />SECTION 1. That the Special and General City election of May 6, 1995 was duly
<br />called, that notice of the election was given in accordance with law, and thé!t the election
<br />was held in accordance with law,
<br />
<br />SECTION 2. That the tabulation of votes cast in the Special and General election
<br />held on May 6, 1995 for the purpose of electing a City Council Member, Place One, and
<br />a City Council Member, Place Two, a copy of which is attached to and made a part of this
<br />ordinance, is adopted as the official tabulation of the votes cast at the election, and that the
<br />tabulation be filed and recorded in the official records of the City of San Marcos as the
<br />official canvass of the election.

<br />SECTION 3, That the official canvass of the returns of the election reflects the
<br />following:
<br />
<br />A. That the following person was duly elected City Council Member,
<br />Place One of the City of San Marcos:
