<br /> 88 <br /> RESOLUTION 1995- 156 R <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN <br /> MARCOS, TEXAS, APPROVING THE TERMS AND CONDITIONS <br /> OF AN AGREEMENT BETWEEN THE CITY AND DSW <br /> INVESTMENTS FOR PURCHASE OF PROPERTY ADJACENT TO <br /> THE 900 BLOCK OF CHESTNUT STREET; AUTHORIZING THE <br /> CITY MANAGER TO EXECUTE THE AGREEMENT ON BEHALF OF <br /> - THE CITY; AND DECLARING AN EFFECTIVE DATE. <br /> RECITALS: <br /> 1. The citizens of San Marcos approved the acquisition by the City of certain <br /> land adjacent to Chestnut Street to be used as a greenbelt and drainage basin for the <br /> protection of the San Marcos River, in Proposition No. 30 in an election held April 5, 1986. <br /> 2. The City Council desires to enter into an agreement with DSW Investments <br /> for the purchase of a portion of this land, being Lots 86, 93, 94, 95, 100, 101, 102, 103 and <br /> 109 of the Third Division, Park Addition (the "Property"), located adjacent to the 900 Block <br /> of Chestnut Street. <br /> ~ <br /> BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br /> TEXAS: <br /> PART 1. That the terms and conditions of the Real Estate Contract attached to this <br /> Resolution between the City and DSW Investments for purchase of the Property are <br /> approved. <br /> PART 2. That the City Manager, Larry D. Gilley, is authorized to execute this Real <br /> Estate Contract on behalf of the City. <br /> PART 3.
