78 RESOLUTION 1995 - 201R A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS APPROVING THE SALE OF THE OLD FIRST CHRISTIAN CHURCH, LOTS 3 AND 4, BLOCK 15, ORIGINAL TOWN OF SAN MARCOS TO THE ABUNDANT LIFE CHRISTIAN CHURCH; AUTHORIZING THE CITY MANAGER TO EXECUTE A DEED; AND DECLARING AN EFFECTIVE DATE. RECITALS: 1. On October 9, 1995, the City Council approved the solicitation of bids for the sale of a parcel of real property identified as Lots 3 and 4, Block 15, Original Town of San Marcos, located at 222 West San Antonio Street in San Marcos, Texas. 2. The City has complied with the requirements of Section 272:001 of the Texas Local Government Code regarding the sale of property by a municipality. 3. On October 31, 1995, the City received a high bid .of $200,000.00 for the sale of the property described above from Abundant Life Christian Church; however, this bid was accompanied by $1,000.00 in bid security rather than the $10,000.00 (5%) required by the bid documents. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: PART 1: That the sale of the parcel of real property described above for $ 200,000.00 to Abundant Life Christian Church is accepted and approved, and the requirement in the bid documents for 5% bid security to be submitted with the bid is waived to require the full amount of bid security to be submitted by December 4, 1995; provided that if this amount is not so received, the bid is rejected and Part 2 of this Resolution is inoperative. PART 2: That the City Manager, Larry D. Gilley, is hereby authorized to execute a Special Warranty Deed conveying to Abundant Life Christian Church the property described above.
