RESOLUTION NO. 2012-165R <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF <br />SAN MARCOS, TEXAS SUPPORTING THE PROPOSED <br />CREATION OF THE CRYSTAL CLEAR SPECIAL UTILITY <br />DISTRICT; AND DECLARING AN EFFECTIVE DATE. <br />RECITALS: <br />1. Crystal Clear Water Supply Corporation ( "Crystal Clear WSC ") is a non -profit water <br />supply corporation operating pursuant to Chapter 67, Texas Water Code with a certificated <br />service area which includes portions of Guadalupe, Comal and Hays Counties; <br />2. The Board of Directors of Crystal Clear WSC has unanimously supported the creation <br />of the Crystal Clear Special Utility District to replace Crystal Clear WSC; <br />3. At its special membership meeting held August 23, 2012, the membership supported <br />the creation of a Special Utility District to replace Crystal Clear WSC (voting as follows: For: <br />182; Against:29) <br />4. The benefits of the creation of a special Utility District include the district's ability to <br />obtain tax exempt financing for water improvement projects, access to purchasing through the <br />state purchasing coop and lower liability insurance rates; <br />5. The proposed Crystal Clear Special Utility District will be a non - taxing district to <br />have all powers and authority of a Chapter 65, Texas Water Code Special Utility District; <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br />PART 1. The San Marcos City Council, acting in a duly noticed public meeting hereby <br />expresses its support for the creation of the proposed Crystal Clear Special Utility District. <br />PART 2.
