141 RESOLUTION 1994- lSOR . A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, APPROVING A CONTRACT BETWEEN THE CITY AND THE SAN MARCOS CHAMBER OF COMMERCE FOR THE ADMINISTRATION OF HOTEL OCCUPANCY TAX FUNDS DURING THE CITY'S 1994-95 FISCAL YEAR; AUTHORIZING THE CITY MANAGER TO EXECUTE THIS CONTRACT; AND DECLARING AN EFFECTIVE DATE. RECITALS: 1. The State Legislature has authorized Texas cities to collect an occupancy tax on hotel and motel rooms and has approved certain expenditures from the proceeds of this occupancy tax in Chapter 351, Texas Tax Code. 2. The City Council of the City of San Marcos has levied a hotel occupancy tax, as enacted in Article II of Chapter 26 of the Code of Ordinances of the City of San Marcos. 3. The City Council wishes to contract with t)1e San Marcos Chamber of Commerce for the administration of a portion of the funds collected from the hotel occupancy tax. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: PART 1. That the Convention and Visitors Bureau budget of the San Marcos Chamber of Commerce for the 1994-95 fiscal year, a copy of which is attached to the contract approved herein, is approved. PART 2. That the terms and conditions of the Contract for Tourism Promotional Services between the city of San Marcos, Texas, and the San Marcos Chamber of Commerce for the administration of funds collected pursuant to Article II of Chapter 26 of the Code of Ordinances of the city and Chapter 351, Texas Tax Code, a copy of which contract is attached hereto and incorporated herein for all intents and purposes, are approved. PART 3. That the City Manager, Larry D. Gilley, is authorized to execute this contract on behalf of the city of San Marcos. PART 4.
