<br /> 16 <br /> RESOLUTION 1994- 158 R <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY <br /> OF SAN MARCOS 1 TEXAS, RATIFYING THE CITY <br /> MANAGER'S EXECUTION OF DEEDS AND CLOSING <br /> DOCUMENTS IN CONNECTION WITH THE CITY/S <br /> AFFORDABLE HOUSING PROGRAM AND THE CITY'S <br /> TEXAS COMMUNITY DEVELOPMENT PROGRAM CONTRACT <br /> NO. 700068 WITH THE TEXAS DEPARTMENT OF <br /> HOUSING AND COMMUNITY AFFAIRS¡ AND DECLARING <br /> AN EFFECTIVE DATE. <br />RECITALS: <br /> 1. The City and the Texas Department of Commerce (succeeded <br />as to this contract by the Texas Department of Housing and <br />Community Affairs) entered into Community Development Program <br />Contract No. 700068 for an affordable housing program on January <br />151 1991. <br /> 2. The City completed the construction of four homes at <br />521, 601, 605 and 607 Valley Street in San Marcos under the <br />affordable housing program. <br /> . <br /> 3. The City was the owner of the lots upon which these <br />homes were constructed, and the sale of the homes was accompanied <br />by the conveyance of the lotsl in accordance with the City's <br />commitment to donate the lots as part of its contribution to the <br />program. <br /> BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> PART 1. That the conveyance of Lots 2A and 3A of Block 101 <br />Lot 1 of of Block lOA and Lot 1A. of Block 11 of the D.S. Combs <br />Addition to the City of San Marcos, as shown on the replat thereof <br />filed at Volume 6, Page 43 of the Hays County Plat Records, in <br />connection with the City's affordable housing program is <br />determined to serve a public purpose within the meaning of that <br />term in Section 272.001(g) of the Texas Local Government Code, and <br />the conveyance of such lots and the improvements thereon for less <br />than fair market value is approved. <br /> PART 2. That the execution of deeds and other closing <br />documents by the City Manager, Larry D. GilleYI is ratified for <br />the sale of the lots described in Part 1 above to qualified <br />purchasers, for prices determined to be appropriate through <br />consultation with the Texas Department of Housing and Community <br />Affairs. <br /> PART 3.
