97 RESOLUTION 1994- 187 R A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AUTHORIZING THE CITY MANAGER TO SUBMIT AN APPLICATION TO THE TEXAS NATURAL RESOURCE CONSERVATION COMMISSION FOR A PERMIT TO CONVEY AND USE EDWARDS AQUIFER WATER WITHIN AND FROM THE SAN MARCOS RIVER; AUTHORIZING ACTION IN SUPPORT OF THE APPLICATION; AND DECLARING AN EFFECTIVE DATE. RECITALS: 1. The City Council has determined the need to diversify the City's water supply so that the City does not depend entirely on the Edwards Aquifer as its sole source of water. 2. The citizens of San Marcos have given approval to an $8.5 Million bond proposal for the development of an alternative water supply. 3. The City Council wishes to begin the state administrative processes necessary for the City to secure rights to surface water to serve as an alternative water supply. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS. TEXAS: ~ PART 1. That the City Manager, Larry D. Gilley, is authorized to submit the application attached to this Resolution to the Texas Natural Resources Conservation Commission (TNRCC) for a permit to convey and use Edwards Aquifer water within and from the San Marcos River in amounts equivalent to the City's discharges of aquifer water to the river at the City's wastewater treatment plant. PART 2. That the Director of Public Works is authorized and directed, on behalf of the City, to appear and arrange for the appearances of persons representing the City at the hearings and other proceedings on the application before the TNRCC, and to otherwise direct prosecution of the application on behalf of the City.
