<br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY
<br />OF SAN MARCOS, TEXAS, AMENDING THE FUTURE LAND
<br />USE MAP OF THE MASTER PLAN OF THE CITY, FROM
<br />COMMERCIAL TO PUBLIC FOR 4.875 ACRES, MORE OR
<br />LESS OF LAND AREA IN THE J.M. VERAMENDI LEAGUE
<br />NO. 2 IN SAN MARCOS, HAYS COUNTY, TEXAS, BEING
<br />THAT 3.63 ACRE TRACT OF LAND DESCRIBED IN A~
<br />DEED FROM W.C. CARSON, TRUSTEE, TO SCRUTCHIN
<br />PROPERTIES, INC. DATED JANUARY 10, 1980 AND
<br />RECORDED IN VOLUME 337, PAGE 253 OF THE HAYS
<br />COUNTY DEED RECORDS AND BEING THOSE TWO TRACTS
<br />OF LAND DESCRIBED IN A DEED FROM P.H. RHEW, TO
<br />SCRUTCHIN PROPERTIES, INC. DATED MARCH 7, 1980
<br />AND RECORDED IN VOLUME 339, PAGE 326 OF THE
<br />HAYS COUNTY DEED RECORDS, LOCATED ON THE
<br />SOUTHWEST SIDE OF THE 400 BLOCK OF RIVERSIDE
<br />DRIVE AND DECILARING AN EFFECTIVE DATE.

<br /> WHEREAS, on October 27, 1992, the Joint Planning and zoning
<br />Commissions of the City of San Marcos held a public hearing
<br />regarding a request to amend th'e Future Land Use Map of the Master
<br />Plan from Commercial to Public for 4.875 acres, more or less, of
<br />land area in the J.M. Veramendi League No. 2 in San Marcos; Hays
<br />County, Texas, being that 3.63 acre tract of land, described in a
<br />deed from W.C. Carson, Trustee, to Scrutchin Properties, Inc. dated
<br />January 10, 1980 and recorded in Volume 337, Page 253 of the Hays
<br />Cgunty Deed Records and being those two tracts of land described in
<br />a deed from P.H. Rhew, to Scrutchin Properties, Inc. dated March 7,
<br />1980 and recorded in Volume .339, Page 326 of the Hays County Deed
<br />Records, located on the' Southwest Side of the. '400 Block of
<br />Riverside Drive; and,
<br />
<br /> WHEREAS, subsequent to.the, publiC bearing'on that date, the
<br />Commissions' did, on October 27, 1992, consider, the request and
<br />voted to approve it and have recommended that .the request be
<br />approved by the City Council of the City; and,
<br />
<br /> WHEREAS, the City CoUncil held a public hearing on the llthday
<br />of January , 1993,'.regarding the request; and,
<br /> WHEREASi all requirements of the Master Plan Pertaining to
<br />amendments have been met; and,
<br />
<br /> WHEREAS, the City Council hereby finds and determines that the
<br />adoption of the following:resolution is in the interest of the
<br />public, health, 'morals, welfare and safety; now, therefore,
<br />
<br /> BE IT RESOLVED BY THE CITY coUNcIL OF THE CITY OF SAN MARCOS,
<br />TEXAS:

<br /> PART 1. That~the following described tract of real property
<br />located on the Southwest side of the .400'Block of Riverside Drive,
<br />San Marcos, Hays. Count~, Texas, which is.in an area shown on the
<br />Future Land Use Map of the Master Plan of the City of San Marcos as
<br />Commercial shall be shown on that map as Public:
