120 RESOLUTION 1993- 36 R A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS APPROVING THE TERMS AND CONDITIONS OF AMENDMENT NO.4 TO AN AGREEMENT BETWEEN THE CITY OF SAN MARCOS AND THE UNITED STATES DEPARTMENT OF AGRICULTURE SOIL CONSERVATION SERVICE; AUTHORIZING THE CITY MANAGER TO EXECUTE THE AMENDMENT ON BEHALF OF THE CITY; AND DECLARING AN EFFECTIVE DATE. WHEREAS, on September 26, 1990 the City of San Marcos entered into an agreement with the United States Department of Agriculture Soil Conservation Service (the "SCS") for improvements to City recreation facilities in the Upper San Marcos River Watershed (Project Agreement No. 69-7442-0-99); and, WHEREAS, on March 23, 1992 the City approved Amendment No.2 to the original agreement which extended performance time until August 31, 1992; and, WHEREAS, on August 24, 1992 the City approved Amendment No.3 to the original agreement which extended performance time until December 31, 1992; and, ~ WHEREAS, it is necessary to amend the original agreement to extend the performance time until March 1, 1993 and to provide for the construction of a timber-pole bridge in Ramon Lucio Park; now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: PART 1. That Amendment No.4 to the original agreement between the City and SCS, a copy of which is attached hereto and incorporated herein for all intents and purposes, is hereby approved. PART 2. That the City Manager, Larry D. Gilley is authorized to execute Amendment No.4 on behalf of the City. PART 3. That this Resolution shall be in full force and effect from and after its passage.
