' <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY <br />OF SAN MARCOS, TEXAS, AMENDING THE CITY'S <br />ELECTRIC UTILITY TARIFFS TO INCREASE THE RATES <br />FOR CERTAIN CUSTOMER CLASSIFICATIONS; <br />PROVIDING FOR SEVERABILITY¡ REPEALING ALL <br />CONFLICTING ORDINANCES; PROVIDING FOR' <br />PUBLICATION AND PROVIDING AN EFFECTIVE DATE. <br /> <br /> <br />WHEREAS, the 1993 Electric Rate Study performed for the City <br />by the consulting firm of Saffer, Vumbaco, Brown & Kersten has <br />indicated the need to increase the rates of the City's electric <br />utility for the Residential Service (RS) , Small General Service <br />(SGS) , Large General Service (LGS-Secondary) , Large General Service <br />(LGS-Primary) , Municipal Pumping Service (MP) , Park Service (PS) , <br />Street Lighting Services (SL) and Outdoor Area Lighting Service <br />(OAL) customer classifications, resulting in an overall increase in <br />annual revenues of 2.83%; now, therefore, <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br />SECTION 1. That Section 9~-1 ::-f the San Marcos Code of <br />Ordinances is amended to read as follows: <br /> <br />Sec. 9~-1. San Marcos Electric Utili tv rate schedules. <br /> <br />The city electric utility rate schedules shall be <br />established and amended by the city council by ordinance <br />from time to time, and a copy of the current rate schedules <br />shall be kept on file in the office of the city secretary. <br /> <br />SECTION 2. That the San Marcos Electric Utility Proposed <br />Electric Rate Schedules attached to ,this Ordinance as Appendix A <br />are hereby adopted. <br /> <br />SECTION 3. That if any word, phrase, clause, sentence, or <br />paragraph of this ordinance is held to be unconstitutional or <br />invalid by a court of competent jurisdiction, the remaining <br />provisions of this ordinance shall remain in effect as if the <br />unconstitutional or invalid portion had not been adopted. <br /> <br />SECTION 4. That all ordinances and resolutions or parts of <br />ordinances or resolutions in conflict herewith are hereby repealed. <br /> <br />SECTION 5.
