' AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AMENDING THE CITY'S ELECTRIC UTILITY TARIFFS TO INCREASE THE RATES FOR CERTAIN CUSTOMER CLASSIFICATIONS; PROVIDING FOR SEVERABILITY¡ REPEALING ALL CONFLICTING ORDINANCES; PROVIDING FOR' PUBLICATION AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the 1993 Electric Rate Study performed for the City by the consulting firm of Saffer, Vumbaco, Brown & Kersten has indicated the need to increase the rates of the City's electric utility for the Residential Service (RS) , Small General Service (SGS) , Large General Service (LGS-Secondary) , Large General Service (LGS-Primary) , Municipal Pumping Service (MP) , Park Service (PS) , Street Lighting Services (SL) and Outdoor Area Lighting Service (OAL) customer classifications, resulting in an overall increase in annual revenues of 2.83%; now, therefore, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: SECTION 1. That Section 9~-1 ::-f the San Marcos Code of Ordinances is amended to read as follows: Sec. 9~-1. San Marcos Electric Utili tv rate schedules. The city electric utility rate schedules shall be established and amended by the city council by ordinance from time to time, and a copy of the current rate schedules shall be kept on file in the office of the city secretary. SECTION 2. That the San Marcos Electric Utility Proposed Electric Rate Schedules attached to ,this Ordinance as Appendix A are hereby adopted. SECTION 3. That if any word, phrase, clause, sentence, or paragraph of this ordinance is held to be unconstitutional or invalid by a court of competent jurisdiction, the remaining provisions of this ordinance shall remain in effect as if the unconstitutional or invalid portion had not been adopted. SECTION 4. That all ordinances and resolutions or parts of ordinances or resolutions in conflict herewith are hereby repealed. SECTION 5. That the rates adopted in this ordinance shall apply to all customer bills dated on and after October 1,1993, and the caption of this ordinance shall be published in a newspaper of general circulation in the area as required by the Charter of the city of San Marcos, Texas.
