88 RESOLUTION 1993- l6lR A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, APPROVING THE RELEASE OF AN EASEMENT INSOFAR AS IT IS LOCATED WITHIN THE SENDERA AND PARKLANE GARDEN HOMES PHASE I SUBDIVISIONS; AUTHORIZING THE CITY MANAGER TO EXECUTE A PARTIAL RELEASE; AND DECLARING AN EFFECTIVE DATE. WHEREAS, the city is the owner of an electric utility easement originally granted to the Texas Power and Light Company as recorded in Volume 112, Page 304 of the Hays County Deed Records (the "Easement"); and, WHEREAS, the Easement does not contain a description which readily permits it to be located on the ground, and all or part of the Easement may be located within the boundaries of the Sendera Subdivision and the Parklane Garden Homes Phase I Subdivision, as respectively recorded in Volume 6, Pages 77-79 and Volume 5, Page 163 of the Hays County Plat Records; and, WHEREAS, the City is satisfied that adequate provision is made within these subdivisions for electric distribution and transmission facilities in easements and rights-of-ways; and, WHEREAS, the owners of the property within these subdivisions have asked the city to release the easement insofar as it is located within the subdivisions; now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: PART 1. That the release of the easement described above by the city as it pertains to the two subdivisions described above is I hereby approved. PART 2. That the City Manager, Larry D. Gilley, is authorized to execute the Partial Release of Easement attached to this resolution to effect this release. PART 3.
