RESOLUTION 2013 -29R A RESOLUTION OF THE CITY OF SAN MARCOS, TEXAS, DETERMINING A PUBLIC NECESSITY TO ACQUIRE CERTAIN INTERESTS IN REAL PROPERTY, INCLUDING, IF NECESSARY, THROUGH THE USE OF EMINENT DOMAIN TO CONDEMN PROPERTY; GIVING NOTICE OF AN OFFICIAL DETERMINATION TO ACQUIRE PROPERTY FOR THE HUNTER ROAD EXPANSION PROJECT; AUTHORIZING THE CITY MANAGER TO TAKE ANY AND ALL REASONABLE ACTIONS TO ACHIEVE SAME; ESTABLISHING PROCEDURES FOR THE ACQUISITION OF PROPERTY; AUTHORIZING NEGOTIATIONS FOR THE ACQUISITION OF THESE INTERESTS; RATIFYING PREVIOUS NEGOTIATIONS AND ACTION; AND DECLARING AN EFFECTIVE DATE. RECITALS: 1. The City of San Marcos, in partnership with the Texas Department of Transportation, is engaged in a project to widen and improve Hunter Road (FM 2439), from Wonderworld Drive (FM 3407) to north of Bishop Street ( "Project "). 2. The Project is required for the preservation of the public health, safety and welfare, and for the public convenience and necessity of the citizens of the City. 3. The public purpose of the proposed Project is to enhance safety and mobility by decreasing the current traffic congestion, and improving safety for all vehicles and pedestrians in the project area while improving the conveyance of storm water and Purgatory Creek floodwaters within the City of San Marcos. 4. The Project requires the City to obtain fee estates, rights -of -way, utility easements and other interests in certain real property in the City of San Marcos, Hays County, Texas, in the surveys described in Exhibit "A" attached hereto, either by purchase or by proceedings in eminent domain. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: PART 1. The facts and recitations set forth in the Recitals of this resolution are hereby declared true and correct. PART 2. The City Council finds and determines that the Project is required for the preservation of the public health, safety and welfare and the public convenience and necessity for the citizens of the City. The City Council further finds that the public purposes of this Project are to improve transportation, improve vehicle and pedestrian, and improve the conveyance of stormwater. PART 3. The City's representatives, agents and staff are authorized and directed to initiate, proceed with and conclude negotiations with the owners of real property interests needed in connection with the Project, and to initiate and prosecute to conclusion proceedings
