RESOLUTION 2013 -29R <br />A RESOLUTION OF THE CITY OF SAN MARCOS, TEXAS, DETERMINING A <br />PUBLIC NECESSITY TO ACQUIRE CERTAIN INTERESTS IN REAL PROPERTY, <br />INCLUDING, IF NECESSARY, THROUGH THE USE OF EMINENT DOMAIN TO <br />CONDEMN PROPERTY; GIVING NOTICE OF AN OFFICIAL DETERMINATION <br />TO ACQUIRE PROPERTY FOR THE HUNTER ROAD EXPANSION PROJECT; <br />AUTHORIZING THE CITY MANAGER TO TAKE ANY AND ALL REASONABLE <br />ACTIONS TO ACHIEVE SAME; ESTABLISHING PROCEDURES FOR THE <br />ACQUISITION OF PROPERTY; AUTHORIZING NEGOTIATIONS FOR THE <br />ACQUISITION OF THESE INTERESTS; RATIFYING PREVIOUS NEGOTIATIONS <br />AND ACTION; AND DECLARING AN EFFECTIVE DATE. <br />RECITALS: <br />1. The City of San Marcos, in partnership with the Texas Department of <br />Transportation, is engaged in a project to widen and improve Hunter Road (FM 2439), from <br />Wonderworld Drive (FM 3407) to north of Bishop Street ( "Project "). <br />2. The Project is required for the preservation of the public health, safety and <br />welfare, and for the public convenience and necessity of the citizens of the City. <br />3. The public purpose of the proposed Project is to enhance safety and mobility by <br />decreasing the current traffic congestion, and improving safety for all vehicles and pedestrians <br />in the project area while improving the conveyance of storm water and Purgatory Creek <br />floodwaters within the City of San Marcos. <br />4. The Project requires the City to obtain fee estates, rights -of -way, utility <br />easements and other interests in certain real property in the City of San Marcos, Hays County, <br />Texas, in the surveys described in Exhibit "A" attached hereto, either by purchase or by <br />proceedings in eminent domain. <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS: <br />PART 1. The facts and recitations set forth in the Recitals of this resolution are hereby <br />declared true and correct. <br />PART 2. The City Council finds and determines that the Project is required for the <br />preservation of the public health, safety and welfare and the public convenience and necessity <br />for the citizens of the City. The City Council further finds that the public purposes of this <br />Project are to improve transportation, improve vehicle and pedestrian, and improve the <br />conveyance of stormwater. <br />PART 3. The City's representatives, agents and staff are authorized and directed to <br />initiate, proceed with and conclude negotiations with the owners of real property interests <br />needed in connection with the Project, and to initiate and prosecute to conclusion proceedings <br />
