ORDINANCE NO. 2012-50 <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF <br />SAN MARCOS, TEXAS, AMENDING THE SAN MARCOS CITY <br />CODE, SUBPART C, THE "SAN MARCOS SMARTCODE," BY <br />MODIFYING LIGHTING STANDARDS AND SIGN STANDARDS, <br />ADDING DOWNTOWN ARCHITECTURAL STANDARDS, AND <br />ADDING AN APPENDIX WITH DOWNTOWN DESIGN <br />GUIDELINES; INCLUDING PROCEDURAL PROVISIONS; AND <br />PROVIDING AN EFFECTIVE DATE. <br />RECITALS: <br />L The adoption of this Ordinance is in the interest of the public health, safety <br />and welfare. <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS: <br />SECTION 1. The San Marcos City Code, Subpart C, is hereby amended as <br />follows: <br />A. Table 3.6 is hereby amended as shown in Exhibit A, attached <br />hereto and made a part hereof for all purposes; <br />B. Section 5.11., Signage Standards, is hereby deleted; <br />C. Article 6, Definitions, is hereby deleted and replaced with a new <br />Article 6, Downtown Building Design, as shown in Exhibit A, attached hereto and <br />made a part hereof for all purposes; <br />D. Article 7, Sign Standards, is hereby added as shown in. Exhibit A, <br />attached hereto and made a part hereof for all purposes; <br />E. Article 8, Definitions, is hereby added as shown in Exhibit A, <br />attached hereto and made a part hereof for all. purposes; and <br />F. The Downtown Design Guidelines as shown in Exhibit A, attached <br />hereto and made a part hereof for all purposes, are hereby adopted as an appendix <br />following Chapter 8. <br />SECTION 2. If any word, phrase, clause, sentence, or paragraph of this <br />Ordinance is held to be unconstitutional or invalid by a court of competent jurisdiction, <br />the other provisions of this Ordinance will continue in force if they can be given effect <br />without the invalid portion. <br />
