<br /> ~ 67 <br /> ~ <br /> 0'"'" <br /> - <br /> ,- <br /> cr. <br /> rl <br /> ORDINANCE 1992- ~ <br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br /> MARCOS, TEXAS, AMENDING THE OFFICIAL ZONING MAP OF <br /> THE CITY BY ZONING LOTS 71 AND 76,OUT OF THE THIRD <br /> DIVISION OF THE PARK ADDITION TO THE CITY OF SAN <br /> MARCOS, TEXAS, AS RECORDED IN VOLUME 56, PAGE 47 OF <br /> THE HAYS COUNTY DEED RECORDS, LOCATED AT 1105 AND <br /> 1107 CHESTNUT STREET FROM "MF-4" MULTI-FAMILY <br /> DISTRICT (HIGH DENSITY) TO "DP-2" TWO-FAMILY <br /> DWELLING DISTRICT (MEDIUM DENSITY) AND DECLARING AN <br /> EFFECTIVE DATE. <br /> WHEREAS, on February 18, 1992, the Zoning Commission of the <br /> City of San Marcos held a public hearing regarding a request to <br /> change the zoning from "MF-4" Multi-Family District (High Density) <br /> to to "DP-2" Two-Family Dwelling District (Medium Density) for <br /> Lots 71 and 76, of the Third Division of the Park Addition to the <br /> City of San Marcos as recorded in Volume 56, Page 47 of the Hays <br /> County Deed Records, located at 1105 and 1107 Chestnut Street; and, <br /> WHEREAS, subsequent to the public hearing on that date, the <br /> Commission did, on February 18, 1992, consider the request and <br /> voted to approve it and has recommended that the request be <br /> approved by the City Council of the City; and, <br /> WHEREAS, the City Council held a public hearing on the 8th <br /> day of June , 1992, regarding the request; and, <br /> WHEREAS, all requirements of Appendix A, General Zoning <br /> Ordinance, of the Code of Ordinances of the City of San Marcos <br /> pertaining to amendments have been met; and, <br /> WHEREAS, the City Council hereby finds and determines that the <br /> adoption of the following ordinance is in the interest of the <br /> public health, morals, welfare and safety; now, therefore, <br /> BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br /> TEXAS: <br /> SECTION 1. That the Official Zoning Map of the City, as <br /> described in Section 3 of the General Zoning Ordinance is hereby <br /> amended to rezone the following described real property located in <br /> San Marcos, Hays County, Texas, which is presently zoned "MF-4" <br /> Multi-Family District (High Density) to "DP-2" Two-Family Dwelling <br /> District (Medium Density): <br /> LOTS 71 AND 76, THIRD DIVISION OF THE PARK ADDITION TO THE <br /> CITY OF SAN MARCOS RECORDED IN VOLUME 56, PAGE 47 OF THE <br /> HAYS COUNTY DEED RECORDS. <br /> SECTION 2. That this Ordinance shall be in effect ten (10) <br /> days from and after its passage and after it has been subject to <br /> reconsideration by the Council at its next regular meeting <br /> following its passage, and providing that the Council did not vote <br /> to reconsider it. If reconsidered on June 22, 1992 it shall be <br /> in effect ten days from and after its passage on that date if <br /> approved. It shall not go into effect if denied. If not <br /> reconsidered and apprõved it shall be published in a newspaper of <br /> general circulation in the area as required by the Charter of the <br /> City of San Marcos, Texas. <br /> PASSED, APPROVED AND ADOPTED this 8th day of June , 1992, <br /> subject to reconsideration at the next regular City Council meeting <br /> scheduled for June 22, 1992 . <br />
